wax selling question re: ebay

over the last two weeks, i just opened and sold a factory sealed 1989 upper deck high series wax case. i opened 4 boxes myself and sold 16 on ebay. today i receive an email stating the following:

Dear ld_ferg,

packs came today, i set down to watch baseball game and let my son open the packs. after awhile i asked him if he got any good cards yet, he said no i said let me see if i can pull a good card. at that time i realized he had opened all but three packs so i opened the remaining three and realized that there was only 13 cards in each pack, i then counted all the cards and to my surprise there was only 13 cards in each of the 36 packs with only 5 no name rookies.
no griffey jr. no randy johnson no john smoltz no gary sheffield no ramon martinez no sandy alomar jr.
my thought is these packs have been opened.i hope i have not been scamed. i should get a refund which i will go thru ebay and or paypal to recover loss and leave negative feedback. (i have opened boxes before and not receive a griffey jr. rookie thats ok but not to receive any that i listed above and there was only 13 cards per pack that is not right.i will wait to here back from you before i proceed.

have any of you ever heard of 13 cards per pack from upper deck? even though it was their first year wouldn't QC catch this type of error. i know in 1981, donruss used to pack 19 cards rather than 18, but i've never heard of this.

i've also had one of the buyers already post pulling a griffey and 2 smoltz. i asked each buyer individually to post their major pulls in feedback to let others know.

how would you handle?

  • if your auction was as described, i don't think he can do anything. i think he might be scamming you, and using his kid possibly to make the story more realistic. how do you know he didn't pull everything he listed, and is going to send you back junk. i find it hard to believe out of 1 high series box (which star rookies were packed more frequently) that he didn't pull not one of those players. i would tell him that what you sent him was as described, so he can't get his money back from paypal or ebay. the only way would be a refund, and i wouldn't even do that. your auction was for a sealed wax box, that is what he got. not unless you guaranteed him a sandy alomar jr rc in that box. tell him to get real and let you know what he REALLY pulled. and what is he complaining about? no star rookies (HAHA my arse) or that the tamper proof packs from a sealed box were ALL short, meaning an UD production issue from 15 years ago.

    not true about the 13 cards and perhaps no good rookies but do you offer a guarantee on good cards pulled??

    You do not package them you sell them.

    He probably pulled a griffey and johnosn and is scamming you
    just my two cents worth

    THe threats about ebay and paypal are what make me think this guy is full of it.

    he is going to neg you anyway why give him money too???

    what did you get out of your 4 boxes??

    do you really believe he got the one box of cards that was short 72 cards???

    the 72 cards short is what gets me. i guaranteed nothing other than these were straight from a factory sealed case just opened. even one of the recent buyers has posted pulling a griffey and 2 smoltz from one box.

    i stated the major pulls i had on my description just to let buyers know.

    i do think i am being scammed here. i'm getting ready to respond to the buyer now.

    Total scam. UD packs are not like wax - they can't easily be opened and resealed. They are foil packs as you know, and once torn, that's all she wrote.

    That is exactly what I was thinking...I remember those packs being sealed in such a way that they were tough to open without ripping. I am sure he is probably just seeing what he can get out of you, but you don't owe him anything other than an untampered with box.

    I agree with everyone else. He is scamming you. Tell him the best you can do is send him some Alomar star rookies and other junk star rookies from that set from the boxes you opened.

    So, he got a bad box. Tough. We all take this chance when buying packs and boxes.
    Let him proceed. He won't get his money.
    Many of us have opened tons of the foil packs. They are as tamper proof as any of the product out there today.
    If he leaves you a neg, then respond and tell everyone to check your other feedback on these boxes.
    Prospective bidders will get the idea.
    Hang in there. You are the one getting "scamed", as he puts it.

    Ditto - tampered '89 UD packs are as obvious as the sun in the sky. He's playing you; I'd point out the tamper-proof nature of the packs, the roll-of-the-dice nature of buying unopened, etc. Be as professional and as sympathetic as you can, but don't give him anything. He's either a liar or a whiner. Have you checked his feedback?

    here was my reply to him last night:

    these boxes came straight from a sealed factory case. i have pictures of
    me opening this sealed case on the week of may 23rd. please look at my
    feedback and you can tell i am no scam artist. you can also tell from the
    feedback that these boxes were not tampered with. one of the sellers has
    already posted pulling a griffey and 2 smoltz. 13 cards per pack (thats 72
    cards short in a complete box). how in the world can i open these packs and
    resell them? in the high series foil, you should receive an average of 12
    low and 3 high numbers per pack, totaling 15 per pack. i know in 1981,
    donruss sometimes packed 19 rather than 18, but i've never heard of an upper
    deck problem....and with 13 in a pack thsi would be a problem, this would
    not pass thru QC (even if it was their first year). from the 4 boxes i
    opened, this was not the case at all.

    i value what i sell to anyone. however, i will not offer a refund because
    you did not pull a griffey or a johnson or the other rookies you mentioned.
    if you will notice in my description, i have opened 4 boxes personally and 2
    of them did not have a griffey, johnson, etc... there is no way i can
    guarantee anything in these packs other than their authenticity. all of the
    boxes have sold and i've asked each buyer to post their pulls in my
    feedback. i would ask that you wait for a few of them to post before you
    think that i have done anything to the packs. i have no reason to not
    deliver the product i sell. you will not see my trying to scam anyone. i
    do feel bad that you are not satisfied, but i cannot offer a refund on this
    type of purchase in which i can not guarantee what you will get other than
    what i described (complete foil box from factory sealed case).

    Great job! I think you were empathetic yet very firm and utmost "professional" in your response.
    I hope this guys 'sees the light' and drops his story which may be more about whining than anything else.

    As Phillyfan has put it, we have all been in this situation.
    What would this guy had done if he got a crap Exquisite pack!
