The scans are good so someone buying this coin knows exactly what they are getting. Assuming that's the original PCGS tag, the coin has at least been authenticated. It's not unusual to crack a coin out but keep the PCGS label for reference.
Calling this coin MS however is just stupid.

The fact that it has a PCGS BB insert also is no guarantee that PCGS EVER authenticated it. If they pulled out a coin and immediately saw that it was say harshly cleaned, it goes straight to the body bag and no examination for authenticity would be done on it. For example if you added an S mintmark to an 1893 dollar and then cleaned it with baking soda he first thing the grader sees will be the harsh scrubbing and you will most likely get the coin back with a body bag that just says 1893-S harsh cleaning, not altered.

Neither. He knows exactly what he's doing. There are plenty of people cruising eBay who will look and not really see.

The scans are deliberately done in such a way so that at first glance the coin appears to be in a slab.

This is also a lie. The MS on the bodybag simply means the coin is a circulation strike, it does not mean it's uncirculated.
