selling unlicensed Broder cards is illegal, right?

the seller www.aawow.com on ebay routinely sells unlicensed Wayne Gretzky Indianapolis Racer "pre rookies." they were made illegally in the early 90's, and have no collectible value. of course, he's selling them as a "rare warehouse find, valued at over $100 each" in his auctions. typical aawow business ethics.

this is against ebay rules right? cause if so, im gonna report them. im getting sick of sifting through their crap trying to find stuff on ebay

    I know I am suffering from Postitis - but I looked in his website and they are not there and is his ebay AA-Collectibles - which has no sales right now?
    You really gave me Vietnam flashbacks with that Broder 10$ crap - while I was in Saudi/war, I sent my son Topps DS which he had sold a bunch and made more $ than I ever dreamed but I now remember that he had bought a slew of really neat looking stuff which of course turned out to be worthless - the trades he made at the time for DS cards would at that time be a minimum of 125$! Now that was a youngster who was very, very upset. Who knew at the time? You are right on target, some unsuspecting neo-collector will get burned.

    i sent him an email saying you know damn well that's a worthless unlicensed card, and he told me that he would sue me if i tried to contact ebay to take his auction down. ok, sure.

    I don't think it's ILLEGAL to sell such a card, because then it would make it illegal to own one. I own a whole set of Broder's, and while I lament that they're worthless, I'm not hiding from the cops, nor do I plan on destroying or selling the cards.

    The cards may have been produced without the proper licensing agreements, and that was probably illegal only for Broder--and maybe not even illegal enough for jail time, only a fine and restitution. Once a product like this makes it out into the world, you can't punish people, like myself, who bought some without realizing the problem. Now, if I were to ever sell them, I'd certainly let the potential buyer know the history, but I don't think I'm obligated to tell them.

    A lawyer's take would be interesting, but like I said, I'm not cowering in fear that the sportscard police are going to come and hunt me down for owning something so benign and unthreatening.

  • selling them is illegal. owning them isnt. same as unlicensed artwork with team logos (actually unique pieces can be sold, but selling reprints or lithos is illegal w/o league approval and trademark compensation)

    I thought his problem with ebay was the fact that in his title he claims they are psa 10's or am i reading it wrong?

  • I haven't seen anything illegal about owning a counterfeit card. I think what makes it illegal is selling as being real. I haven't seen ebay end any auctions that clearly stated the had the "reprint" gretzky rookies.

  • a few years ago i reported a dealer who was selling cards of ken griffey jr. in his high school baseball uniform. he was making really outlandish claims (including psa would grade them, which is not true) ebay told me we`re like a huge yard sale and all we do is rent out table space, you as the buyer take all responsibility for what you buy and what you choose to beleive a seller tells you.
    its the old saying; let the buyer beware.And what law enforcement agency do you think has jurisdiction to act on this type of "crime" ?
    legally, i think this case died years ago.

  • There is a seller on ebay selling bootleg DVD's and people have reported them, but Ebay still hasn't done anything, not even with all the negative feedback and feedback stating the seller Outbidyounow is selling dvd-r's.

  • i have bought those bootleg dvds and while they say that they are imported from asia or china or some crap, they are nothing but copys. however, the reason that MOST people don't complain is the fact that that particular movie is not available on dvd. you should already know it's a bootleg. you ain't gonna get dvd quality from a vhs tape just because you put it on a cd.

    i don't even have a vcr, how else am i gonna watch STONE COLD?

    I'm no lawyer, but I would have to guess that Newbie is right. I don't imagine it's illegal to sell the cards, as long as there is a caveat that these are not officially licensed cards. The way he represents them is wrong. On a related note, anyone have a take these?
