You win an auction on eBay from a first time seller but since he is not happy with the price, he relists it the next day.

This happened to me once before and it just happened now. I won the auction last night and it just got re-listed!

Yes, but the seller had an exact same copy of the card that I just won.

since he's a not-so-wise newbie, e-mail him and ask him to leave you a positive and you will do the same, then neg him after he leaves you your positive and he has to pay the final value fees and you're just out your time to bid and frustration

I have tried to contact him and if he does not respond I will leave him a neagtive. If he leaves one for me too there's not much I can do about it.

Based on the looks of the item, I really doubt it.

True, but I also wouldn't trust this listing, period. No stated shipping costs, and the very ambiguous "good condition" - too many red flags here besides the 0 feedback rating.
