I had the same situation couple weeks ago. The picture was perfectly designed and angled so that you could not see the flaws. Furthermore, the person made no mention whatsoever of the serious flaws of this coin. It would have gotten body bagged coming out of the envelope for the first time along with a seven gun salute.
Well, I wrote the person a furious letter. I informed them that basic rules of eBay is to best represent your item the way it is, flaws and all. If for some reason you can't get the picture to show the major flaws, then they should be discussed in some way in the coin description. I told this person that they misrepresented the coin on purpose. There were even descriptive adjectives that said things like "beautiful I appeal" and "gorgeous coin". Trust me, it was everything but that. I got on to live chat and present in my case to the technician, and the technician said I had a case and she gave me a link for who to talk to. I informed the seller of this and told her that she should be ashamed of her self.
It ended well. Before it had to come to blows, she offered a full refund on the coin. I think the fact that she might have been investigated (which the technician told me she would) scared her, and she figured it was worth sending the coin back rather than be investigated for fraud. If the person backs down and agrees to return your money, send the coin insured and registered.

PayPal told me to hold on to them until they do some investigation...I guess so that they will make sure and doesnt lie about getting them back...he lied about everything else.
Buying raw isn't a problem. It's buying raw and sight unseen that is. And for all intents and purposes ebay auctions are sight unseen. That is why a return policy is necessary and essential.
Don't count on paypal to ensure you get a refund. I just got taken for $45 by a seller called firefighter70043. Totally mis-represented coins that were returned with proof of delivery. Paypal said they could only force a refund if the item was not received at all and insured.
koynekwest, I believe you have to be over a certain amount before they will insure...mine was for $278.20...so I think they will work on this one...they had better.
Puff most people are not aware, all they see is the positive and think it is alright...I looked at his feedback and most of the were positive...I dont like to get screwed on purpose....the way ebay does things is not right...it promotes the lying and fradulant actions by the sellers.
Return the coin registerd mail where he must sign for it-keep all your copies, contact your credit card company immediately-LIKE NOW, the hell with paypal -and dispute the charges, turn copies of everything you have to them even the signed return slip. Make sure you pay for the green return slip. Present all the evidence you have to your credit card company that "item not as described"-returned, and that's that...even include copies of email in which he tells you that you may return it. Make your case as trump tight as possible..THEN you go to the FBI IFCC web site and even the USPS and file complaints for mail fraud. Been there-done that and have yet to lose a dispute! State and Make your case to your credit card company! Dispute it NOW-they'll send you forms... by this time you will have the signed return slip which you will make a copy of and enclose with all your other evidence! OK?

If automatics were given out I would be owed a few hundred at least. I looked up and down Ebay's feedback policy and I wasn't able to find anything about Ebay leaving feedback. Did you receive a notice or something?
It just doesn't seem very logical for them do something like that. But we are talking about Ebay.
Sadly, eBay is a haven for rip-off artists and there is more protection for the crooks than the good guys, just like regular society....

They are probably back selling under a different name by now. Paypal was of absolutely no help at all, nor was my credit card company as I didn't notify them immediatly. I was giving people the benefit of the doubt.
One of these guys stole over 30K from buyers in about 3 weeks, passed himself off as a bullion dealer and delivered just fine for a couple of months, then pulled off a big scam and left eBay, moved from his address and cut off his cellphone, utilities, etc.
Ebay at least took the time to tell me about how many people he had ripped off, I was one of the lucky ones who only lost $500 or so. The police in his city were made very aware and told me that they gotten had many calls from all over the US about him.
Anyway, the moral of this story is that eBay can be a tough place, I try to stay will sellers I have a history with or I keep it down to a low bid that won't hurt too bad if the worst happens.
I do check feedback, but that can be deceiving. Sellers can have negatives removed, at least the Power Sellers can, I've watched it happen and I still don't think that is right, I've only given one neg in my life and it was removed by eBay within 3 days. They told me that they couldn't explain that policy decision to me as I was not the seller.
I am bidding less and less on eBay these days.

If you are going to do a charge back on your credit card make sure you've transfered an money out of your paypal account first, because they will freeze your account and those funds will not be available to you.

you are going to have a TOUGH time then utilizing solely Paypal. If you do file a complaint with paypal you'd better get whatever money you've got/want from your accounts.
Well let them freeze it cause I will not be using it again...If they do not take care of this, then slowly but surely their business will someday fail.

they are a broker - selling many items with 'stock' photos - to them (the crew, 1 person can not handle that many transactions), they all look the same -
if they said send it back - do it - make sure it is insured for full value
there are many sellers doing the same thing -> PCGS MS68 modern piece of generic junk - proof sets - mint sets -
they also may have 5 or 10 on hand - ask them if you could exchange it for one where the Kennedy half dollar does not have many marks on it
if it was still in government case, how could it not be uncirculated? and how could it be lower than SMS64 ?
even though you are disappointed - the picture does not show very clearly the items - they may not even know the half dollar is the 'jewel' of that set - just they go for $250-280.

As many others have already pointed out, this is completely false. There is no such thing as "automatic" feedback. In point of fact, were eBay to implement such a system it would destroy their ability to legally claim they are nothing more than a conduit and are not responsible for the activities that happen on their site.

I just received a $219 refund by filing a PayPal claim. It was smooth and easy. The item was received, was defective and I returned it to the seller. When he didn't issue the refund, I filed the claim and ten days later the money was back in my account.
Happened to me once a few years ago with a power seller on eBay. I bought a raw Indian from him and PCGS said it was counterfeit. Seller claimed return privilege was forfeited when PCGS opened the holder -- and that the resolution of the auction photo (quickly removed from its page) was insufficient to identify the coin. (Yes, the auction page did say something to this effect, but that presupposed it was the real thing, right?)
eBay said there was nothing they could do. My negative feedback was soon swamped by thousands of other feedbacks. The coin was still gold, so I traded it - in the bodybag - at a show for two certified Lincolns.
Two cents for my gold coin! Lost over $100. End of story.
