The second one is nearer VF or Fine, somewhere between - with that much wear on the shield, and the bad pics, I'm convinced the buyer would be really disappointed...
The first one is a way higher grade but not that attractive - if these coins are not cheap then they have to really look nice IMHO.
I'm with coinkat- keep lookin'. While neither of those is totally nasty, they both leave something to be desired. The second one would have been OK with me but for the long hairline Cacheman pointed out. Looks like a nasty staple scratch.

The second one in the UK is looking pretty worn... poor pics but it takes a fair bit to get the shield to really show wear on these...
