Need expert help with an eBay issue

Check out this auction I won. Now... getting by the fact that I'm an idiot for giving my business to a rookie seller listen to this.

I received these cards about a week ago and they're obvious fakes. sharkface2003 (the seller) apologized telling me he didn't know they were fakes but that he'd already spent the money and couldn't pay me back. blah blah blah. He offered me what he said was the only other card he owned. It's a PSA 1 Delong Gehrig. Then the guy disappeared from the face of the earth. He hasn't answered an e-mail since.

Tonight I found this auction. I've sent e-mails to each bidder warning him about this guy.

Do any of you have experience with an issue like this? Can I get my money back some other way? I paid via bank transfer using Paypal but didn't pay for their money back guarantee so Paypal won't help me. We all know the eBay dispute process isn't all that helpful.

Any suggestions?

    you might want to try the internet fraud complaint center. i've never used but it's surely more responsive than the unholy ebay-paypal alliance. you might also want to see if any agencies in the seller's home state would be willing to help out. i once got burned on a horribly overgraded card from a seller in virginia and was able to get a partial refund by filing a complaint with the state's deptartment of agriculture and consumer affairs. contact the office of the attorney general of this shyster's home state to see what, if anything, you can do.

  • File a paypal and an Ebay fraud complaint. If you don't get your money back, at least it will get him kicked off of EBay. Also, I agree with a complaint to the police dept in his home town. And a complaint about postal fraud with the post ofice wouldn't hurt either.

    You may never get your money back, but if people start investigating this scammer, he may respond by trying to make good with you.

  • Well...the cheat cancelled his auction and sent me a nasty e-mail. Apparently one of his shill bidding friends told him I sent e-mails warning about his dishonesty.

    His e-mails says I will "NEVER" get money from him because his auction stated all sales are final. Haaaa....this door knob thinks that covers his ass for acting fraudulant. Getting this guys thrown of eBay is my new quest!!! I'm just sorry the eBay process takes so long.

  • 1 obtain sellers true name and address 2 report to local DAs office 3 retrieve all of other sellers auctions with name of all bidders ( look for shill friends) 4 report to local BBB 5 file small claims suit for 1000s inc atty fees 6 obtain judgment and hound him to death

    The best way to handle this is twofold.

    1) I have had luck with contacting the local authorities. Then send them all of the corroborating facts that you have (include his emails). In the negative feedback that you give him, state "When you get ripped off contact (Police Authorities Name) at (Police Authorities Phone). Odds are, this guy has ripped off or will rip off others with the same tactics. In my case, the guy got 3 phone calls and then paid a visit to the seller. I received reimbursement with a few days after that.

    2) File an EBAY fraud alert. You can get up to $175 back from EBAY insurance by going this route. This method helped me get a $2600 deal reimbursed with one of their very own Power Seller Square Trade Members. At minimum, it can get part of your money back and start the wheels rolling to get this id kicked off EBAY so that this guy can open a new one and start all over.

  • So far I've heard from 8 of the 40+ people that have bought off this guy. Seven of them received fake cards but all of them got their money back easily and left him positive feedback. Can you believe that? All of these people gave positive feedback!!

    Anyway...my case is building. I just need to find someone who can tell me what city this guys from. I know he's in California.

    Although these happenings are not fun for the people involved...ie GoSoxBoSox, they sure are pretty good reading. I enjoy hearing about these jokers getting what's coming to them.

    Keep on the path Sox, and keep us updated. Too bad he's not in Mich., I could apply the royal smackdown to his arse.

    So far 7 fakes, 4 likely fakes, 3 cards not received, and 1 guy gave his card way (he doesn't know if it was fake). One of the guys sent me a scan of four 1935 National Chicle cards, one of which is the fake he received..... it's pretty obvious which is the fake (scan is attached). Anyway.....I believe they all got their money back which is great.

    A bigger issue is he's still ripping people off based on his 100% positive feedback. Everyone gave positive feedback so eBay is turning the other cheek unless we take action to stop him.

    Perhaps the biggest issue is that I haven't heard from many others that have bought cards that are the same make and year as many of the fakes he sold. No doubt these poor people have fakes as well.

    I'm still drumming up more information...........
