The Charlotte Transcripts (ACG vs. Stuppler)

After the hearing in Charlotte, I was supposed to receive an official copy of the transcript. Unfortunately, some problems arose out of taking a paid-for copy and publishing it on my site. Fortunately, someone was there to take down the proceedings in shorthand in case there was any funny business with the transcripts. To make a long story short, it has taken weeks to translate shorthand into text, but here are the first three excerpts:

Diane Hager's Opening Statement

Barry Stuppler's Opening Statement

Diane Hager's Presentation of her "evidence"

I will add more as time permits. This is a very time consuming chore.

Very insightful. She actually believes what she is saying. Amazing!

the sad thing is that Diane just does not understand the big picture.

    Diane:

If you happen to read this please figure out that your company overgrades coins and this is where the problem is!

how much simplier could it be?

I said it before and I'll say it again...If Accucrap expended as much energy correcting THEIR deficiencies as they do pursuing their critics, they'd be doing pretty good by now.

I came away from the hearing pretty sure that Diane Hager actually believes was she said at the hearing. From what I can gather, she is nothing but a figurehead for Alan Hager, and was programmed by him before the hearing. I would have much rather been able to confront Alan, but now that both have resigned from the ANA I will never get the chance unless they are stupid enough to file a lawsuit against me. By the way, Alan made sure he was nowhere near the hearing when it took place.

imageSo after the FTC actions against PCGS and NTC, would you trust any of their slabs before 1990? The reason they grade conservatively is based on the actions against them in Federal Court! I'm not defending ACG and some of their questionable actions, but could your coins be an actual higher grade and are not because of previous legal actions!
Self-serving grading was the case in both FTC actions! Go figure!image

Wrong. The PCGS case was about self-serving marketing, not self-serving grading.

Sorry, Clank you have competition. Diane had me rolling on the floor. "don't let him distract you by talking about our grading" I have it on good authority from a gargoyle or devil ...." "of course our coins are downgraded; it's THEIR fault, it's a conspiracy"

I had to stop reading before I peed my pants.

Oh, it gets better Joe. Those were the first three parts of a total of 15. Just wait until I post the transcript of my testimony! Bwuhahahaha! image

You know, something just occured to me. Since it was obvious in her presentation that she was picking my posts out by my icon, I have just reverted back to my usual icon so she can clearly see my posts. She is probably one of those people who have to get a picture menu at Burger King.

My testimony is part 11 of 15. I thought about posting it first, but I think it is important to go through every thing in order so the person who wasn't there can understand the cumulative effect of how ridiculous her position was. I'm hoping to get these done by the end of the week. To give you an idea, it took me seven hours to transcribe her presentation.

They didn't- there was quite a bit of chuckling and snickering when she made that statement. That is one bad thing about these records- they don't note the many times the spectators broke out in laughter in response to some of her comments. A couple of times when this happened, I noted several board members obviously squirming. They didn't like having to deal with this issue at all.

I must say her opening statement was rather weak. It wasn't powerful and persuasive enough. I could probably write a better one!

I thought Ms. Hager is an attorney? If so, her presentation was incredibly disjointed and showed a lack of research. She should have worked on determining the relationship between K6AZ, Greg, Mr. Stuppler, the PCGS boards, rec.collecting, etc. As it stands, she seemed to lurch from one point to another (Bringing in P&G??? Come on!!!). But, I might be too critical. It could be that her efforts were the best she could do, either because of her skills as an attorney or because of the strength of her case.

One point did interest me: Did NGC actually conduct the experiement Ms. Hager mentioned of submitting coins to PCGS in NGC slabs and then resubmitting the coins after cracking them from the NGC slabs?

What's also interesting about that picture is that a recent poll of the 108, count 'em 108, dealers that admit to doing business with Accucr@p, 45% identified the first individual as being Diane Hager, 35% thought it was the third one and only 20% picked the person in the middle. image

Well...I don't know about the two guys on either end, but the one in the middle is DEFINATELY Willy Nelson!
  • I guess there is some justice. Look at the first thing Alan has to see every morning! I'd kill myself! BTW anyone have a picture of him? I'm kind of curious what he looks like too.
