<< <i>Fellow seller, your accusation is not appreciated. The pic in my auction was retrieved from my pic gallery from way back when I bought this coin nearly two years ago. I may have even bought it from you back then. Who knows, your name is familiar and I'm sure I have bought from you at some point in time over the past year or so. I save pics of all the coins I buy, sir. Should the need arise to resell them I have pictures of them saved and available to post. Had you received a bid for $249 on a similar item, I hardly think I'd be hearing from you, would I? I see there is at least one other 55 cameo in the same PCGS grade available. You might want to take a look at that picture as well. It looks just like ours! But, then again, his asking price is higher than yours, so I guess he won't be hearing from you. >>
P.S. I never bought or sold from this guy. When I replied to his email it bounced.

We haven't had a good blood-letting around here in almost 3 weeks!

What this means is that a perfect record in feedback is hardly definitive of a dealer's honesty; and even a few negs, presumably from brave souls risking retaliation, can be an important warning sign.

I emailed him asking if the image was of the actual coin he was selling.
I know Ebay will not do anything, unless they receive their own harshly worded letter indicating that as the ISP and website, they too will be joined in this matter. Once Ebay has to send their lawyers to a Fed. District Court for a TRO hearing, they might be a little more inclined to police themselves and NARU these sellers.
That sucks! If I can help let me know, I got a little experience in this area.

<< <i>Hi Russ, I decided to end this auction early, but thanks for your interest.
The coin is sold and is exactly as I described it complete with my 30-Day
Money Back Guarantee to the buyer. Thanks, again. Mark >>
Notice how he deftly skirted actually answering my question? The coin is sold my ass. He ended the auction early because he knew he was nailed.

How to protect your copyrighted descriptions and images which you have previously used on eBay.
Occasionally, you may find that your image or description text has been used by another seller in their listing. If that happens, please report this to Trust & Safety.
To report the unauthorized use of your copyrighted image to eBay, go to our Contact Rules & Safety web form and click on: "Questionable Content on eBay", then "Unauthorized use of image, text, or links", and then "Use of Pictures, Text, or Links without permission". You will be provided with an email form, where you can enter the offending item number in the item number box. Be sure to include an item number of one of your listings containing your copyrighted material in the body of the email to us. Please also explain exactly how your rights have been violated.
Remember that you can only report images that you own the copyright to, such as pictures you took yourself. If you obtained the images from the internet, you likely do not have any rights in them.
Hope that helped. I had to print out some kind of form and fill it out, sign it stating I owned the picture and fax it to ebay before they did anything. But it worked.

3012186837 is my obverse and reverse. The pics are from two different coins. The obverse is from a 66 but the reverse is a 64.
3012187752 is my obverse and reverse. By the way, this coin is actually a 65.
3012188605 is my obverse and reverse. The obverse photo is from a 1958 MS 65 and the reverse is from a 1956 MS 66 FBL.
All five of these coins are currently in my possession.
What a scumsucker!

Uhh, yes, I have done that already. I advised him via e-mail that I was onto just exactly what he was up to and was going to get him in a load of trouble. However, I didn't tell him specific auctions and even clicked on an unrelated one to e-mail him through the Question for Seller feature. Here's the message I got back:
Sir, with all due respect. What coins exactly are you referring to in your
claim, "to sell your coins on eBay?" Your question comes to me via a a 1991
DC Comic Batman comic I have listed, so again, with all due respect, I'm
confused as to what coins your are referring to and the "several images" you
are referring to that you claim I used to actually "sell" my coins.

I intentionally used the comic book auction so wouldn't know which ones I was on to. You know very well what you have done. I suggest you cancel ALL of your auctions with stolen images and ALL of your auctions for items you do not have. I don't intend to let you in on the little secret about which specific ones I know about. I have, however, started reporting you to various agencies with jurisdiction over your activities; and, as I can think of or figure out others I will report you there too.

I did see that he cancelled the bids and ended at least the three auctions in which he was using pics he ripped from me.

Well, at least he keeps good records of whose photos he ripped off. That eliminates the "innocence" defense.

I've done some other investigations. I have the name and phone number of his employer and have verified that he is who he says he is. I suspect now that most of his auctions are legit. However, he probably had a few coins without images so he stole some. The cert numbers he listed in the auctions with my pics do not go with the coins in my pics. When I looked them up, I saw the cert number matched the described coin. So, he probably would deliver a coin with the grade and holder specified but obviously it would not match the pics.
Let's all keep an eye on him the next few weeks. Maybe he's had enough scare to go straight now.

Dear Mr. Herndon,
I can see that you are, sir, and I do not want a war with you or anyone else
for that matter.
I will contact the buyer of the 1955 FH and give him an opportunity to back
out of the deal per your request.

> OK, I've done some checking around and think you're likely okay but just
made a slip in stealing some pics. My guess is you really have the coins
you described but don't have the ability to image them so you stole some.
If that's the case, I'm guessing you would have delivered a coin matching
your description (but not the pictured one of course). If I had the tiniest
inkling (or get it going forward--I will be watching your auctions) that you
were making up coins, stealing pictures, keeping money and not shipping
anything, I'll see to it that charges are brought against you.
>
> I see you have cancelled several auctions, including the ones with pics
you stole from me. Before cancelling them, you cancelled the bids. I do
have concern about one auction that has ended already and has a high bidder.
I strongly believe that the pictures used are not of your coin. I have
contacted the person I believe took those pictures and owns that coin to
verify for a fact that the pictures used are of someone else's coin. I
should have that evidence by morning. In the meantime, I'm going to give
you a chance to redeem yourself if you really are okay but made a slip on
the picture.
>
> Here's the honorable thing for you to do. You need to explain to the
winning bidder on that coin that you used pics that were not yours and were
of some other coin. You need to give him the opportunity to back out of the
auction or go ahead and look at the coin and decide if he wants to keep it
or not even though it was not the one pictured. You should have this person
e-mail me and verify that you have come straight with him. If you do not
take the honest approach, I will assume your intent was dishonest and will
continue to see that any wrongs you have committed (such as consumating the
above auction having used stolen pics) are reported to the various
authorities.
>
> I was planning to call your supervisor at [company name deleted] in the morning to see
if you are a honest person or not but I will hold off on everything until I
hear back as to how you plan to proceed and as to whether the other pics are
stolen. As to several of the auctions you cancelled, I myself took those
pictures and am prepared to prove that fact in court if necessary. I am
quite serious about this matter.

Why would you call his supervisor @ work. Is he selling these coins personally or for a dealer he works for?
