  • I won the last libel suit I defended against, and it only cost my client's insurance company $60,000 (1969 bucks at that!)image

That did include a lot of expenses other than attorney fees, but the Plaintiff was a deadbeat and the court cost judgment against him is still unpaid. image

    Nuff said?image

Adrian -- was that criticism, of a personal nature in your post? Ah, interesting.

To answer smprfi's question -- it depends, you would probably have to look at the bylaws and guidelines of the ANA and see if the hearing and it's results are public, if not, then it would probably be in violation of their rules to make the results public, which might cause additional problems for whoever reports the outcome of this particular issue, since the outcome will probably only be known by a select group of people.

This really isn't a true "lawsuit," it's a hearing before a private body. No litigation protection against slander/libel would apply, in my opinion. And I doubt highly whether the ANA is going to get into the question of ACG's grading policies in this instance. Though, they probably should.

As for reporting anything, facts rarely get you into trouble, as long as they can be confirmed. It's how you state your opinions that usually lands you in court.

It will be interesting to watch though.

  • According to the forwarded email from Stuppler(?) that I received, the ANA hearings are supposed to be open hearings so it should be public.

In the past I have volunterred to help fight the fight, but there was never a fight on the table. I suspect more people would come forward to help if we had a better idea about the scope of this thing, and where the help was needed.

I'm not clear, for starters, just what BS is being accused of, but presumably it is not acting in accordance with guidelines governing his position in the ANA. Depending on what the issue is, testimonials and the like are not necessarily relevant. If they are, I would think the PNG survey may be particularly persuasive, since ACG finished a distant last, even against the likes of ICG and PCI and SEGS, and that is saying something.

For anyone with access, there is a published case Hager v. Hager involving a family dispute amongst the Hagers, and it is an entertaining read.
    I brake for ear bars.
