THE RESOLUTION - From Bob Green at Park Avenue

I announce with great pleasure that I will be buying the J398 back from RkKay. While I have not yet resolved my buy-back issue with the dealer I bought the coin from, I am doing so with the hopes that others who took the time to post on the THREAD OF DEATH - will know that I am committed to customer service.

Of course the obvious question is Did I feel pressure to do so? and my response is NO! I just felt that since the Term DONE DEAL was apparently not fully understood by the buyer (and I think it is now) that he should not be totally penalized.

With regard to my existing "retail clients" and any of you who might perhaps some day give me the pleasure of working with you..........You always have an unconditional return here at Park Avenue Numismatics, unless we agree that it is a DONE DEAL, of course!

    Tom: Hello, Tom’s Art Gallery.

Bob: Hi Tom, It’s Bob from Bob’s Art Gallery. I hear you have a beautiful painting for sale.

Tom: Yes, it is displayed in the front window of my store. I want $30,000 for it.

Bob: That’s a lot of money. But since it’s a beautiful painting I’ll give you $20,000.

Tom: I’ll take $27,000 and you can put it in your store window and sell it.

    Bob: Is it really beautiful?

Tom: Yes it is a beautiful painting. It was rated at 65 by the painting raters.

Bob: I’ll give you $22,500 for that beautiful painting.

    Tom/Bob: Deal
    <<click>>

Tom: Honey, I just sold the painting in the window for $22,500.
Mrs. Tom: That’s wonderful honey, but now our front window will be empty. What ever shall we do?
Tom: I’ll ride into town and use the money to buy a new beautiful painting we can put in the store window.
Mrs. Tom: That is a fine idea. I’m sorry I ever said your paintings were boring.

    Meanwhile…

Bob: Honey, I just bought a beautiful painting for $22,500. We can put it in our store window and sell it for $30,000
Mrs. Bob: That’s wonderful honey, but have you seen the painting and know that it’s really beautiful?
Bob: No, don’t worry. If it’s not beautiful I’ll just get our money back.
Mrs. Bob: That is a fine idea. I’m sorry I ever said your paintings were boring.

    Later on…

    <<Ring>>

    Tom: Hello, Tom’s Art Gallery.

Bob: Hi Tom, It’s Bob from Bob’s Art Gallery. The painting arrived and I don’t think it’s a beautiful painting like I thought it would be. I want to get my money back like we agreed.

    Tom: Huh?

Bob, just to avoid any more confusion, you might want to edit this sentence you wrote :

"..........You always have an unconditional return her at Park Avenue Numismatics, unless we agree thatit is a DONE DEAL, of course"

I believe you meant to write "here" and not "her", unless you used "her" in place of the coin in question. image

    Bob,

Can you put up a scan of "her" for us also......It may be a "done deal!"image

All kidding aside, Bob has sent me quite a few coins on approval.....and if I wasn't happy I return them the same way he sends them.....Express mail! The last one I looked at at the FUN show and had second thoughts about it.....called Bob up and asked if he could send it to me to look at again.....he did! Sent it back with a check to cover his shipping since I had to see it twice.....check came back with "void" wrote on it and a thanks!

Happy to see both parties come to an agreeable resolution to this deal!

Good for you, Bob. It's a fine gesture on your part.

I hope you can unwind things with the other dealer so nobody has to be put out.

New collectors, please educate yourself before spending money on coins; there are people who believe that using numismatic knowledge to rip the naïve is what this hobby is all about.

Unfortunately, this thread will not get NEARLY the attention that the original did...very sad.

Well done to both parties. However, I still think RKKAY should have attempted to work things out before venting. Someone openly flaming me before attempting to rectify a problem would only have strengthened my resolve. Just my humble opinion.

    Cheers,

    Outhaul,

Even though I was the only coin boarder in the world that didn't post on the Thread of Death, I assure you I read it, and read this as well. Considering the hoopla, I expect this happy resolution will receive the same amount of attention, even if we don't get twenty zillion posts on it again.

Since I have the mike, I'd like to say that all's well that ends well.

While this is a rough audience, the folks here recognize fairness and good business practices, by and large. As you can see by the posts already made, such practices worked through in public here can result in a burnished reputation for the dealers, even though the process can be painful!
  • Whether or not this thread gets any attention was not the reason for the post. Since I am a virtual newcomer to the Forum I felt compelled to offer the results. Little did I know that the same issue was going on "across the street", much to me dismay........I might add that the traffic to my website was overwhelming on Friday and Saturday so you really do get more with honey than with vinegar!

Even had a few nice "sight seen" orders.........imageimage

For the record, if you ever want a scanned image of any coin, just shoot me off a email and you'll have one sent within the hour.

I'm not the big "H" in Texas with 5+ people scanning images, nor do I aspire to be. Just a hard working DEALER with 24 hours in the day (many of which are devoted to running my business), some great clients and a commitment to both.

Did I mention my 3 month old newborn daughter, who I plan to leave coin shows early to attend her soccer games and cheerleading, etc in the future!

Mr. Green, i have not done any buisness with you yet, but as a result of the excellent way you handeled this i am certainly going to try to do some in the future, congrats on an excellent resolution to a difficult situation. One suggestion i made to Rkkay i'd like yours & others opionions on is when doing "done deals" with someone you don't know well, it would be best on coins worth 4 figures or more to make a fax machine contract sent to the buyer to spell out terms such as "done deal" requiring a return signature agreeing to what was said verbaly clearly spelled out, and only after you have that faxed contract signed and returned from the buyer do you send him the coin. What do you think of my idea ?, {it's as simple as a fax machine] barberlover

Mr. Green: Congratulations. If only all business disputes were handled so professionally. I agree with others who posted that this business dispute shouldn't have been vetted so quickly on the forum boards. I can't shake the suspicion that RkKay intentionally used the forum to bring pressure on another dealer whose business policy he did not agree with. If I'm wrong, my apologies to RkKay. Regardless of RkKay's initial motives, however, there is no question Bob Green stepped up and handled this in an exemplary fashion. Well done

    Folks,

It disappoints me to see that some here still ascribe a negative motive to Rick's initial action of posting the issue on the boards. Unless you have extensive personal experience with him, or can read his mind, I suggest that you remember that in this country, a person is innocent until proven guilty.

Similarly, early on in that Thread of Death, people slammed hard at Bob Green without knowing more.

It's funny how so many are now singing a different, more moderate, tune?!?

In short, it would be nice if more of us sat back and tried to accumulate information before pronouncing doom.

  • There are always two sides to every story.

Most of the time each side thinks he or she is right.

The seriousness of the heel digging in business is usually directly proportionate to the amount of money involved.

In this case as in most when true gentlemen are involved a solution is reached when both are willing to give a little.

While I thought there were lessons in the thread, people tend to let their emotions fire too early. Personal attacks (just as are ocurring on another thread now) get you no-where.

This story ended properly, and, I hope there was equal share in its dispensation.

Bob: I am glad to see you resolved this, even though I am told at 2x the penalty to the buyer I personally thought would be the case. But, the stiffer penalty (buy-back fee, whatever one calls it) should be a strong reminder to the "neophyte dealer" to "dot his i's and cross his "t's" in all future deals image Wondercoin

Dang!, and not a single attorney involved, geez, all this warm & fuzzy stuff just has to stop NOW!

What kind a world will it be for MY children, if people work out their differences amicably without the need for attorneys or litigation.

This is not what our tax dollars go to. Do you realize how many judges, clerks, mailroom people, secretaries and support staff will be unemployed if this kinda stuff keeps up?

It could be devstating on the ecomony. Please people, think before you act. There's alot of people depending on you to be an Ahole. Don't let us down!

Really, congrats and it's nice to see two gentlemen, work together to resolve their problems and differences. I rarely see it and it's quite refreshing.

  • I think I learned a LOT more than I ever wanted from the thread.

I'd like to suggest that a commemorative T-shirt be designed, with a statement "I Kept My Mouth Shut on the Thread of Death" for those members who quietly tried to assimilate the knowledge available on it.

Just to be able to recognise folks at shows that didn't have much to say.

  • Parkave, how many law suits involving coin dealers have you been involved with?
  • Two, both with the same coin dealer and neither had to do with buying or selling a coin. Both were contractual lawsuits of former employees who violated restrictive covenants/non compete contracts, by taking our client list to a competitor.

If you were asking if Ive sued regarding a coin deal or been sued for that matter the answer is NO NEVER. Sorry I couldnt help facilitate your drama.

    Edited to say:

Oh, and by the way, I was leaning toward your side of this argument. I am glad that you charged RKkay $1000 to settle this deal as you are entitled to being compensated for your time, considering that this was a dealer-to-dealer, "done deal" arrangement. And congratulations on the addition to your family!!!image

  • Any chance the Thread of Death coin could be reslabbed with the "Thread of Death" designation--perhaps it would sell for a premium!
  • SageRad, That's too funny....and a good suggestion. ACG may be interested in putting that designation on the slab, if you staple a nice, crisp $5 bill to your submission form. The only problem is that if it is currently in a PF-67 DCAM PCGS holder, will ACG have to break Sheldon's "70" barrier and slab it as PF-74 Super-Duper DCAM-a-slama-yo-mamma???

Sorry to hear about your "windfall" at the hands of an attorney. Personally, I would have taken my legal fees in trade, I wonder what I could get for $95,000 in coins!

Well, you weren't the ONLY one, but, I agree with the above sentiments as well.

Just because a thread doesn't get 100 replies doesn't mean it isn't being attended to. BTW, a great majority of those posts were continuing commentary by some of the same people; as is usually the case with any multiple page thread.

I know neither party and simply chose NOT to speculate; much more was gleaned by keeping my thoughts to myself.
