Ebay transaction gone BAD

My deadbeat seller is now racking up bad feedback.... but here is what I left and he left for me....

I left him feedback shown here: Complaint : Received env. w/out gold coin. no response from from him . AVOID. SCAMMER!!!!!!!

Here is my problem.

I purchased a 1oz Gold Bullion coin from a powerseller. He had a couple negs, but all rebuttles seemed understandable.

I won the auction. I send a personal check right before vacation. When I got back from Florida, I had several packages come in via the mail. I signed for them all.

Opened them all. The last one was in a priority mail envelope. It didnt feel like my usual pcgs slab. It felt like just paper or documents.
I pulled out a peice of cardboard with a priority mail lable stuck to it. That was it.

I was confused, so I did my reseach and found the action (as described above). So I started examining the envelope. See this pictire...

I noticed this. When opening the envelope, I was not looking for this, and it was not that obvious. I saw what was pictured. Then, I examined the cardboard. I could make out circular indentation in the label that was affixed to the cardboard. If this was how he expected to get it to me, it was the all times worst packing EVER. THe 1 oz, uncirculated, ungraded coin, stuck to cardboard with a sticker in a larger envelope.

Furthermore, I paid $8.50 for priority mail and INSURANCE. THe package had delivery confirmation - NO INSURANCE.

So, I give him the benefit of the doubt. I email. He emails me one line response that was cut and pasted from USPS webiste.

Your item was delivered at 3:22 pm on January 02, 2003

I replied and told him that indeed that packaging showed up, but no coin......

I have not gotten a response yet - with additional follow ups by me.

Another FISHY thing. His ebay profile, and user info says he is from JASPER , AR. The package shipped from Fresno . CA.

I tried to call, just rings and rings...

    No insurance you are screwed image
    If you paid for insurance and the seller didn't insure it he should pay but sounds like you will have a hard time trying to get your money.

    If you paid for insurance and the seller didn't use it, couldn't you bring it up with safe harbor and E-bay insurance. It seems to me the seller is at fault for not providing the insurance YOU paid for!
    It is not exactly cheating, I prefer to consider it creative problem solving!!!

    It might be a scam.

    Tell him that you want to file an insurance claim. You paid and he needs to file the claim. He didn't buy insurance? Too bad. Then we will never know if the Post Office agrees that the item was lost in transit. Tell him to pay.

    Contact eBay and report the transaction under their fraud policy. Get his ass moving a little faster and protect yourself.

    Seller didn't fulfill his obligations

    If you paid by bidpay - see if you can retract payment.

    E-mail back and say you need to start the insurance claim process because envelope but no coin arrived - if non- responsive start playing ebay war with them - start 2 bogus accts and bid everything up to thousands. - use free email service so they can't find you - ebay will close you down every month or so.

    Not to sound like an unsympathetic wisea$$ but the seller is not legally obligated to purchase insurance even tho you paid for it. He must however be prepared to cover any losses should they occur.
    I would send him an email and threaten him with mail fraud charges.
    If he does not respond then make good on your threat.

    Agree with Bajjerfan, unfortunately. The seller is not obligated to pay for postal insurance, but is obligated to make good on the product if you had an agreement of insurance, regardless of the source of such insurance. "Self insurance" is not illegal, but is binding.

  • Earlier he didnt have many items for sale. He has not sold many coins...now he has lots of 2002 1oz coins listed..LOOKS SUSPICIOUS.

    I have threatened main fraud, and started the fraud process as safe harbor states, but I have to wait 30 days....

    Yes- he is obligated to recoop the costs- whether USPS insurance or some other means- if not, it is fraud, across state lines... a federal crime image

    Here's my opinion:

    You should

    1) spend a little time and energy (not too much) trying to give the guy an opportunity to make good (also report him to the USPS as engaging in interstate mail fraud) but don't get your hopes up too high and

    2) if you are in good health and are married, you should chase your spouse around the house and try to have some fun and try to de-focus on ........what was that that was putting you in a bad mood???

    Very easy interpretation.
    You were offered insurance.
    You paid for it.
    Item was shipped uninsured.
    Seller breached contract.
    Seller is responsible.

  • My advice? Hunt him down, kill him, dismember him! OK, bad idea! Chalk it up to being more careful, he has a lot of negs.


    In total seriousness, I doubt there ever was a coin in that envelope. The opening looks too small for a slab and if it were just one raw coin how could they get it out through that small opening without more damage to envelope?

  • sorry to hear about that. delivery confirmation is a waste of money as far as the buyer is concerned. it just proves that the postal service says that it delivered somewhere, somehow. I'm in the process of trying to collect $400+ from postal insurance because the post office apparently just left an insured package at my front door while I was out of town and it walked off.

  • All those postal workers have to do is push that Priority Mail envelope from both sides and the raw bullion piece will slide to the bottom of the envelope. Then you tilt the envelope with the flapside corner down. The coin slides to the flapside corner. They make that opening and the coin pops out. That opening was PLENTY big enough for a raw 1oz. bullion coin!!

    Most times buyers sign for the envelope and then inspect the package after the postman has left. Buyer is screwed. Warning to everyone receiving coins in those chickencrap Priority Mail envelopes. DON'T sign for the envelope until you have inspected all 4 sides & corners of the envelope. Feel around the envelope until you FEEL a coin inside. Until that is completed, DON'T sign for the package.

    Your claim is with the Post Office. Good luck!

    Did everyone notice the kinds of tactics this guy advocates and uses himself? I guess this is how he gets return privileges when he buys coins. WOW! image

    Loki- You conveniently forgot to mention all those Negatives are coming on the BUYER'S side. Not as a seller. I will agree JamieB is unlikely to get the Post Office to make good on that "broken into" Priority Mail envelope.

    Your package arrive without it's contents. The package had an opening, created prior to arriving at your home, large enough for the cointents to be removed. I can GUARANTEE you I would take it to the manage of my branch and raise holy heck! Just a suggestion... image

Maybe if the guy gets no business that would teach him a lesson. Or send an un-insured package full of hot steamy dog sh*t to his house from out of town using a bogus return address. Just my opinion.
