Peace $ staple scratch ???

I have this Peace dollar that I just noticed has a staple scratch (or maybe tooled) that I think the grading company missed ( I sure did, and I spent longer than 15 seconds looking at it).
It is an extra spike in the crown below the R and is about a quarter of an inch long.
What does this do to the grade (or is it an automatic bodybag)?
I am thinking about sending it back to the company to see how good their guarantee is. My main concern is that it will cost me about $40 to do it (as far as I can tell) - they have it as a MS65 and the rest of the coin definitely is.

I think it's a crap shoot on getting bagged for tooling...but I just don't think it's a simple scratch...
Any ideas would be appreciated.
Maybe it's a known vam.

I'll check the varieties out
for some reason it doesn't look original but newer -> reflection and shine -> could be mistaken though because of very good luster
It goes in - would not be a die-break or crack - it would have to be a planchett flaw?
It is toned overall - a mottled gold>brown>black
I think it looks kinda cool - some people say ugly
