POSTAL CLAIM DENIED, PLEASE HELP!!!!!!!!!

i know that caps are rude but I need help, any help. I was unleashing an F-bomb of biblical proportions at home. I'm very, very P***ed right now. I put this claim in a very small post office after my package was stolen by a postal clerk in Newport Beach. We made one mistake I did not sent it to PCGS first to fill out their part of the claim. I got a letter a while ago that it's being processed and now I got this. I'll take ANY suggestion of how to handle this situation.

    sadysta1,

If I understand you correctly, you did not provide proper documentation (including a statement from PCGS) when you filed your claim. If that is correct, simply get the documentation you need and refile the claim. Try to be patient and cool. Keep copies of all correspondences and documentation involved. Generally speaking, the post office is reasonable in these situations. Hang in there.
  • Not a problem. Fully complete a new claim form, send it to PCGS for information and signature and then submit it, along with an explanatory letter, to the postal authority. This will end up taking longer than you hoped, but I don't believe it will be a problem. Bet you don't make the same mistake twice!

Sorry to hear of your loss. That is a real shame. Did you send the package Registered Mail?

I also had a shipment stolen at Newport Beach in March. When I sent an email to PCGS requesting info as to their receipt, I got a return email from them stating that they had never received it. I then filled out the claim form, and my small-town postmaster said I had everything in order. Then I get the claim back, with the USPS stating I didn't provide written documentation from PCGS. I thought the copy of their email and my proof of insurance was enough. Wrong! So I sent the claim form to PCGS, they signed it and verified that they never received it and I sent the claim in again.

Good news/bad news: I got a check from the USPS. Bad news was they only reimbursed me for $48.49 as it "was the maximum allowed without an invoice". I had insured the shipment for $300 and my claim was for $125 as I had over-insured the shipment. If you think you were p*&&ed, I was even more so. They gladly took my money for the insurance but when they have to pay out, they play that game. Total BS!

I sent the form back, explaining that I inherited my Uncle's coin collection, so therefore I didn't have an invoice or sales receipt. I am now waiting for their next response. If they deny it, I plan on contacting my congressman on the matter.

When I get the next reply, I'll update the board.

    Good luck!!!

  • I'm sure you don't need me to tell you this, but if all else fails, go see your Congressman/woman. I had a much more severe problem with the gov't.involving Soc.Sec. My congressman called and the problem was solved within days.( He wasn't even in my party!) Twowood
  • Patience is the key. Several years ago, I waited three months to receive payment for a stolen package. Maybe they think you'll get tired of messing with it and give up. Just be persistent and patient.

I also had a package stold by the Newport beach USPS employee. I had it insured for $3,000 and I had to fight for my money but I did get it all plus the cost of postage. I followed instructions to a tee and all correspondence was done with overnight mail that had to be signed for with tracking so I knew it was recieved and that things were moving along. The biggest problem I had was proving the value as some coins were purchased long ago and some were worth much more than I paid. I wrote a very nice letter along with the help of my brothers wife who is a lawyer stating that between me and my Dad we had 60 years combined of coin knowledge and that we knew exactly what the value was- a check soon followed. I am still upset about the whole situation. I think anybody that lost a package to this thief should be reimbursed without question as the USPS knows what happened to our coins. mike

I'm in the process of an insurance claim as well - the package was not delivered - insurance paid/delivery confirmation - from an ebay sale/ paid via paypal

got a letter last week saying they didn't like my copy of the paypal receipt saying amount of payment and completed transaction.

Sent another - if they continue this slow pay crap, I'm gonna sue in my county for insurance fraud - as well as file a complaint with my states attorney general.

Other companies are not be able to get away with that.

I still don't understand why the person/business (in your case PCGS) has to fill out anything - they did not receive the package. I do not understand why you or I have to prove the value of anything - if they charge the rate for $xxxx and the postal employee checks the package/delivery address - if any fraud is taking place, it is by them for not paying / or extremely slow paying, in my opinion.

I doubt if any legit insurance company could do what they do and still be in business.

What are we insuring against in non-deliveries? their employee theft?

One would think that when the slimeball thief is their own employee, they might be a little less quick to pull the trigger on a denial and a bit more interested in solving the problem.

  • I also had a package never make it to PCGS and filed an $800 claim with the Post Office. I called PCGS to verify non-receipt, and sent the claim to PCGS for signature verifying non-receipt... I also got a name when I called to address attention to on the envelope. While the PO was not fast, I found that as long as everything was in order, things went relatively smoothly.

  • Other companies DO get away with this kind of stuff. UPS always denies claims the first time. The claims employees are graded on how much they save the company by denying claims. It takes a lawyers letter to get paid, but they have paid two claims for me in the last two years after the letters. Also insurance is a weird duck no matter who issues it. My house was burglarized 7 years ago. A diamond ring was stolen that appraised for 8500.00. It was insured for 9000.00. The insurance company offered to either replace the ring or pay 4800.00 cash. Hmmm. Why didnt I pay insurance on 4800.00? It doesnt work that way.

I may be late on this, or someone may have already posted, but:

Rather than send to PCGS, pay $3.50 for them to verify non-delivery and resubmit via APPEAL

Contact/complete non-receipt portion and resubmit via APPEAL

I believe that since it has been denied, you can't resubmit per se, but you can appeal. It's beyond me why they couldn't just call you and state the form is incomplete - actually, it isn't. I've found most local POs don't have someone competently trained in claim processing and there are always delays due to a lack of something.

Don't forget, place emphasis on "lack of direction," "failure of postal employee(s) to verify completeness", and a simple oversight, NOT NONCOMPLIANCE.

BTW, It is NOT true that the USPS never pays on the first claim. I had to jump through some hoops, but I got all my $hit together and submitted my claim which was paid without resubmission/appeal.

    More importantly,

With the number of people in the forum who have alleged theft/loss of packages going to PCGS, the arrest of some employee out in the Newport Beach PO, why is there no one/nowhere that we can provide sufficient information to possibly effect recovery?? In my case, I was challenging the grade on 3 PCGS slabbed coins and getting on graded/attributed, so I have slab numbers. I have yet to find ANYONE interested in trying to return my stuff OR at the least, gather more direct evidence against this so and so.

  • One suggestion. If the value is several hundred dollars, pay the extra few bucks to send it registered. I was told by the post office that registered mail is delivered under lock and key untill it its delivered to the recipient making it difficult to steal.
  • This story would make a great 60 Minutes or 20/20 story. Has anyone contacted a major news service to air the story. That would get some action.
