Last Saturday I traded several emails with BJ as to the policy that a set had to be registered 90% complete in order to fulfill the requirement for 5 free submissions. I informed him that I thought, as a lawyer, there was some potential problems with the language and that there could be possible litigation from their offer and subsequent denial of the offer - - contracts and that stuff!
****It should be noted that after several additional discussions / emails with BJ, it has become apparent that PCGS did not change their policy due to any perceived legal action, but a decision was made based solely on the fact that PCGS is trying to improve customer service as well as clarify any misunderstandings as to their policies.****
Well, guess what, PCGS has now changed their policy and we will all now get free grading

FREE GRADING BENEFIT UPDATE!
Effective immediately, the free grading benefit no longer requires a set to be NEW and customer service contacted within 5 days of listing. Now, whenever your set reaches 90% complete, regardless of when you may have first listed it, you are entitled to the following free grading benefits:
If the set composition is 1-9 coins you are entitled to 1 free grading.
If the set composition is 10-24 coins you are entitled to 2 free gradings.
If the set composition is 25-49 coins you are entitled to 3 free gradings.
If the set composition is 50-99 coins you are entitled to 4 free gradings.
If the set composition is 100+ coins you are entitled to 5 free gradings.
Free gradings are for coins within the set that has reached 90% completion. All coins must be submitted at one time. If your set has reached 90% complete and you have not previously received free grading for this set, please contact setregistry@collectors.com for an authorization code. No free gradings will be permitted without this authorization code, so be sure to write the number down on the top of your submission form.
So there to all of you that made those lawyer jokes in the NCG vs. PCGS thread

Well, I guess you're ok.
I just wanted to be the 1st to thank you and PCGS for working on this. Sounds like they are being very fair. I for one am glad you pursued it. Now to just find some coins to use it on.

My Washington Type B/C Set
Good deal! I just hit 91% on my type set, and have raw coins to fill in the gaps. Thanks to you, BJ, and PCGS.

That sounds to me like they are offering free regrades.....
What good is free grading on coins already in a set? They have to already be graded by PCGS to be in the set.
Am I reading to much into this?

You can submit raw coins to finish out your set , or to try to upgrade some coins already registered in your set. The free submissions just have to be from the same series.

Strange thing is that, in reality, it never did have that requirement. I've done it twice, and neither set was "new". Both were built a coin at a time, and when I hit 90% I sent in my freebies. They didn't argue, just processed the submissions.

Am I to take this to mean the coin must be "a coin you are using in your set"? Or, is it a coin "required to complete the set"?
In other words, am I expected to use the coin graded free in my set? Or, may I have a coin graded free that's contained in the set, even if I don't plan on using it in the set.
It's a shame you must split hairs these days. Before people started getting paid for dumping coffee in their laps, things were a little simpler.

The only reason PCGS does this and should do it is for market share. More coins in PCGS plastic the better for PCGS and its stockholders. The fact that they would limit what you can do with that coin is ridiculous and well as probably actionable legally speaking, since of course lawyers like to split hairs. I don't see PCGS saying "well that's a nice MS-69/70 or PR70DCam that we graded for free, sorry you can't ever sell and it is must be a part of your set or we'll strike the grade." That just doesn't benefit PCGS in anyway

I noticed my 20th Century Gold set is 1 coin from complete, but not yet 90%. I would hope they will allow a free grade on a less than 10 coins set that is 1 coin from complete.
