Question on a EBAY refund.

Today I received by mail six 1975 Topps Baseball commons in PSA 9 condition. All six slabs were cracked many times as the seller did not provide any protection for the cards. No bubble wrap, no cardboard, nothing. He just dropped six slabs into an envelope.
I want to know how to properly handle this. Obviously I will request a complete refund. Should I also ask him to pay for the return shipping? Does the seller have to issue me a complete refund or will I have to contact EBAY? This has never happened to me before so I have no idea what the proper recourse is.
I can't understand how an EBAY dealer with ample sales would not secure the cards. Is this common for EBAY sellers?

Report a Problem. Take photos of the damage and attach to your correspondence with eBay. They should issue you a return label and the seller should refund in full.

Pretty simple and don't overthink it. Go to your purhcased items. On the one with the issue, click on More Actions and select Return Item. Then select Arrived Damaged. Simply state in the free text box that all the slabs arrived damaged, cracked. Don't be a packaging expert and state that they weren't packaged properly (you would only do this if they were raw cards). State that you need to return them. Then add some photos. After submitting the seller most likely will agree to the return and issue you a pre-paid (or at least no cost to you) shipping label. Then send them back and you'll get your money back a day or two after they are received. If the buyer doesn't agree to the return or doesn't respond, at some point you can escalate to eBay and they will force the return or refund you outright if the buyer is a dick! This happens, but is an easy return in the end, usually. You'll even get back the money you paid for shipping to you if it wasn't free.
Does the seller have returns allowed? I tried to file for a return and had to chat with an agent, eventually got a return but it was harder to do because the seller said no returns.
The seller does not accept returns. I sent him an email this morning and I'm still waiting on a response.
The seller just responded to me and said he would refund me once he receives the insurance payment from the post office. Does this sound right? I doubt the post office will refund the seller in a timely manner. Should I have to wait months for a refund?
Don't play the sellers game.
Go through ebay's system for returning damaged items. Provide photos.

Just file a claim though eBay as mentioned above. The seller will have no choice but to refund you. eBay will send you a return shipping label at the seller's expense. More than likely, the post office won't pay an insurance claim shine he didn't package the cards as he should have.
Call and talk to someone from eBay..
Just an FYI because I had a similar situation today after receiving a card with a non-disclosed crease from a seller who doesn't accept returns, unless.....
First I notified the seller of the problem, then contacted eBay to request a refund and included photos of the crease. Within an hour I had a response from eBay and a return label. The seller messaged me to apologize and commit to a refund. He has 3 days to return funds after the card is delivered back. Easy peasy. Only disappointed as I would have preferred the card. Oh well. That's eBay.

This is the email I received from EBAY:
We'll send you an email when the seller responds to your request. If you have not agreed on a solution or the seller has not responded by Jul 26, you can ask us to step in and help.
So it appears I have to wait for 4 days before EBAY can help me.
Last question for the guys who sell on EBAY. Can a seller issue a refund immediately to a buyer or does the seller have to wait a required amount of days? I'm asking because I'm wondering if the seller could issue me a refund today instead of waiting days/weeks to contact the post office.
The seller could give you a refund at anytime, but generally will wait till he has the item back in his/her hands so that you don't scam him.... And yes, if the seller does not move ahead and issue the return label, you will have to wait the 4 days before you can get eBay to step in, but at that point eBay will probably respond within a few hours and issue the label themselves or just flat out refund you if they think the seller is being a douche (the seller doesn't get to wait for an insurance payout from USPS before making you whole if you've already sent the item back/opened a case). It will all work out in the end, just have patience.....
The fact that a seller does not accept returns does NOT matter when the item is damaged or not as described. 99% of card transactions are probably no returns accepted. You just follow the instructions I imaged above and you are good to go.. No need to email/call/chat with eBay to start a return for a covered reason!

I would give this seller at least neutral feedback for shipping cards without protection, and I would give him a negative for delaying an obvious easy eBay return or advising me to go to the post office.

He took 6 PSA slabs and put them in an envelope, No bubble wrap, no cardboard, nothing. All six slabs were broken in ample places.
When he files the claim, since it was not lost, he's going to be asked to bring the items and the original packaging to the post office for inspection, so don't forget to send that back to him They'll probably deny it for improper packaging.
I just received the email in BOLD below from the seller. He sent the first message yesterday as was my reply. He's claiming he was told that USPS would cover me. Is that correct?
I will work this out with you and will get you a full refund. I am presently working through the post office to get an insurance refund on my end. Please be patient. I will be working on tomorrow and Wednesday

You can keep the cards. I am working on now. thought I could do online, but says I have no insurance so I am going to the post office. Only reason I am hesitating on the refund directly from me is if they say you will be covered by the USPS, then there is another mess getting monies straight. Again, never happened to me before, but happened three times on this set of shipments, so sorting my way through it.
The seller who improperly packaged the cards does not get to dictate the terms of the refund.
That being said, you have some time. I've had situations where the seller refunded me without having to return the item.
It sounds like he's delaying though. It takes USPS a long time to process an insurance claim, and you're under no obligation to wait for him to get his refund from USPS.
Ebay gives the seller 4 days to respond. I'd wait a week, then contact the seller again. If he's still hesitating then request the refund from Ebay and they will force his hand.
Pretty much a nothing-burger as far as what the seller is saying.. Stop engaging, wait the 4 (now 3?) days and then escalate to eBay and they will handle it. USPS has nothing to do with you , the buyer, and will NOT be sending you any money under any circumstances. just sit back with some popcorn waiting for the seller's next bullshit message. How much was the sale of all 6 items combined? Also, no way that you get to keep the cards and the Seller can collect on the insurance. USPS is going to want the damaged items in exchange for the payout. How much feedback does this quack have. Must be his first rodeo or just shoveling the BS...
The total amount was around $150 and the seller has ample feedback -100% - and has sold thousands of items.
The insurance claim with the post office is between USPS and the seller, it has nothing to do with you. Like others have said, go thru eBay and the seller will have to refund you.
The shipping through eBay would come with $100 insurance coverage which would be through the post office. Since the sale was $150, if he bought additional insurance, it would be covered through eBay. That may be why the post office said he had no insurance coverage.
Surprising then that the seller is acting like a low feedback # dipsh*t! Unless he only sells $1 cards usually, you'd think he could handle the return dollar amount and not be like I need USPS to pay me so I can refund you!
Regardless of feedback, this seller is terrible. Not shipping securely and telling you to wait for post office insurance, is lame.
Sounds like a scam. You keep nothing. No seller is going to give you a refund unless you go thru eBay return process because they put themselves at risk of being scammed!

The seller might be hoping that eBay refunds you and pays them, which eBay does do in some cases like this.
Are the cards damaged? I didn’t see if you mentioned that.
Yes 3 of the 6 cards are damaged and now pretty much worthless. The other three appear to be ok. All six slabs have broken plastic that fell into the envelope. There is major damage to all six holders.

The seller emailed me this morning with an apology and a complete refund.

Is he from Canada? I had a similar issue with a Canadian seller.
No he's from the United States. I never mentioned his name as I wanted to give him the chance to do the right thing .
In the end he issued me a refund.
