Is this 1883 Carson City Morgan a fake? problematic seller

Seller with a recent string of bad feedback has a suspicious looking 1883 Carson City Morgan.
Looking at the seller's feedback, seems he is in the business of sending wrong coins and not delivering on his previous sales.

The coin itself, the observe has that off look with no luster that may fakes have, the reverse pic although blurred, you can kind of see the tell tale hit on the upper left of the eagles breast.
More senior eyes, whats the verdict on this coin?
