Two rim nicks away from a straight grade....or not?

I was 4 for 4 on my last LC submission and will have 4 more vouchers in a month when I renew. This 1842 Small Date N-1 is as nice an example in the raw as I have ever seen. Except for the two rim nicks on the reverse. It seems to have some micro porosity or perhaps not...just a finely textured patina. I grade it EF40.....it is a 45 but take 5 away for the rim nicks and net grade it in a straight holder. What do you think?

I like it for what it is, but I don’t think it will straight grade - because of the surfaces, not the rim nicks.
I don’t think the rim bumps alone warrant a details grade, but I’m basically clueless when it comes to early copper. The surfaces might be a little off as well, but I’m sure others will chime in.

I was just going to say, I don’t think those rim nicks are bad enough to warrant details, the surfaces on the coin however, that’s a different story…

The rim nicks would not prevent a straight grade, i’m just not sure about the surfaces of the coin?
