I agree, looks like the exact same coin, just a different flip. I will reserve saying 100% as the second photo is out of focus, I’m 99% the same coin, and color and surface looks better to me in the second picture!

You know, I was thinking the same thing. It might actually be the same coin and it was placed in a different holder after it started to re-tone from its improperly rinsed dipping.
Same coin photographed under different lighting conditions. The seller put it in a fresh 2"X2" holder for you for some reason. It's unlikely an eBay dealer would have two early silver coins like this that have the same date, denomination, and grade.

I cannot put the listing up. I won't do that to another person. I can return it and that's the right way to handle it.
I will tell you this. I just responded to his ebay notification. He said to me "didn't we agree that it was AU before you bought it". What the heck kind of morals does this cat have. If I did agree I would have never posted this thread. I told him I have all of his correspondence tucked away in a nice neat file. We never discussed anything.
Dam I love coins and I like to seek out my next purchase and ebay has lots of coins. Lots of pitfalls too.......
Yea it's the same coin. He even admitted it but he lied to me. We never agreed that I would buy the coin he was selling as uncirculated and be okay with it actually being AU, duh. It's worse than that it looks like someone back in the day checked it with there fangs to make sure it was real lol.

Minimal correspondence. I asked him the usual questions....do you have anything else of interest etc...nothing at all about the grade of this coin. I did blast him a bit because I was upset when I opened the package. Several things come to mind immediately. In this situation he could say I returned the wrong coin to him. Understand?

The pictures didn't show any detail. As with most things bought on ebay you need to see them in hand. Some sellers have awesome images but most of them are like my own just so so. You know I think about it and I wouldn't have been angry if he sent it to me in the unc flip. I would have just figured one more overgraded coin to return. What bothers me the most is very obvious here.

Doesn't matter if you want to sell an AU coin for AU money then list it as such. Everyone wants to get a good deal from time to time. If it were AU and I knew it I would not have purchased it. That's not the point of this anyway.
If the seller hadn't categorized it as uncirculated in the listing I'd say caveat emptor, but the categorization makes it technically not as described.

it doesn't APPEAR this is a common practice as eventually someone (similar to you) would end up dinging the feedback.
did you really think it was not a high au coin upon purchase or are you unhappy with the coin and looking for a reason to return? (i see you posted this above "Everyone wants to get a good deal from time to time. If it were AU and I knew it I would not have purchased it."
i don't think it is the end of the world but i do think you both have something to learn from this one. buyer and seller.
a piece of advice. while you CAN do returns and ding sellers for stuff like this; if you are buying coins that look like this (almost certainly not UNC from those pics) HOPING you are getting a really good deal and then ding the sellers (rightfully so as this is a weird one), i still think you are headed down the wrong path if the ONLY difference between you buying a raw coin like this is whether or not the seller is giving a grading estimate on a flip. my 2c
i was legit expecting some more nonsense on behalf of the seller after seeing the pics in the OP.

It is interesting and perhaps internist intentionally deceptive to have it in a CH UNC holder and then reholder it as CH AU.
The item specifics do say "uncirculated" although they only call it "high grade".

The listing states the seller has a “no explanation needed” return policy. Why don’t you just return it? I don’t understand all the angst.
You can also go the SNAD route as already pointed out.
