I take it that your question is taking in the year when certain US laws were put in place making such coins (counterfeited US coins) illegal. That is to say if it was counterfeited before that law the coin wouldn't be illegal, if produced AFTER, it would be illegal.
If these replica's had dates of manufacture on them, along with origin would make them legal "COPIES".
Its my understanding that unmarked US coin counterfeit's are still counterfeit.
Also to add to that, its against ebay rules and guidelines to sell "replica coins" if the coins themself are not stamped or marked as such "COPY"
