Technically, if DC’s is not a fake since it does not copy the exact real design, then that is not a fake DC since it does not have a broken sword on the reverse.
Too bad DC isn't an advisor to the US Mint. His 2021 $1 products are far superior to the Mint's dreck in so many ways. Prove me wrong. :-)
I am a fan of Daniel Carr's work.
However, using Daniel Carr's own argument, if legal tender of these dates/mintmarks were never officially released, can ANYONE be stopped from producing these fantasy coins?
No. BUT, you can't claim them to be Daniel Carr productions. It's like putting claiming your velvet Elvis was painted by Picasso.
