1936-d “three and one half legged” buffalo nickel slabbed, important question about this slab.

I started another thread on this coin because I thought the coin was overgraded. But now I have another question, that is
should it have been slabbed at all? From the mintmark looks as if just the very top of the mintmark is visible but if it is not
certain whether or not this is a D or an S then If the top of the mintmark cannot be ascertained visually, should the grading
service pass on this coin or slab it like NGC did hear because to date only the 1936d has been found with a three and one
half legged variety? I am assuming here that the mintmark is not distinct enough to tell which mint it is. By the way I would
only grade this fair-02 based on the amount of date visible.

    The experts at NGC were confident enough in their assessment to slab this, and I'll trust that if there was any doubt they would have passed. It certainly has the correct diagnostic/appearance for the 3 1/2 legs variety, plus IMO there is enough of the mintmark visible (particularly the top serif of the D) that it is unmistakably a Denver coin.
