Ebay really needs to get their sales tax collection fixed.

Looks like I'm going to lose another sale. Buyer is in Iowa and is being charged tax. It's not a cheap coin so it does make a difference. The wait time for a call on this is the longest I have ever seen from ebay. Usually I get called in less than a minute...saying 30 minutes. I guess we need to just keep bugging the crap out of ebay!

    In Arizona, causal sales between individuals and, who (not businesses) have occasional sales or are reselling an item are not subject to sales taxes yet Ebay refuses to do their due diligence and research the laws correctly.

    To be clear in Arizona according to Arizona publication 610and 610A

    Publication 610A - Arizona Use Tax for Individual Consumbers

    Are casual sales taxable?
    Casual sales between individuals are not subject to the use
    tax. Items purchased for use in Arizona from persons who
    make isolated or occasional sales and who are not engaged
    in the business of selling tangible personal property at
    retail are not subject to use tax.

    Exemptions
    The use tax does not apply to the storage, use or consumption
    in Arizona of the following:

    2. Tangible personal property on which the Arizona
    transaction privilege tax has already been paid.

    **3. Items purchased from a person not engaged in the
    business of selling tangible personal property (casual
    sale).*

    1. **Tangible personal property brought into Arizona by
      an individual who was a nonresident at the time the
      property was purchased for his own storage, use or
      consumption if the first actual use or consumption of
      the property was outside the state, unless such property
      is used in conducting a business in Arizona.
      **

    **11. Tangible personal property not exceeding $200 in any
    one month purchased by an individual at retail outside
    the continental limits of the United States for personal
    use and enjoyment.

    I think Ebay should be held personally accountable for collecting illegal taxes. Ebay refused to do their due diligence and research the exemptions before collecting taxes.
    How many other states have exemptions like the one Arizona has that ebay is ignoring.

    And the one thing I cant find on the AZ department of revenue is how to recoup taxes illegally taken as with ebay.
    I know amazon collects sales taxes I wonder if they were able to get the exemptions right for Arizona. If so, ebay really needs to be held accountable.

    Arizona has at least 50++ exemptions to the tax rule with one of them being the following:

    Taken from the AZDOR website:

    Exemption #57: Cash equivalents, precious metal bullion and monetized bullion purchased by the ultimate consumer, but coins or other forms of money for manufacture into jewelry or works of art are subject to tax, and tangible personal property that is purchased through the redemption of any cash equivalent by the holder as a means of payment for goods that are subject to tax under this article is subject to tax.
    (c) "Precious metal bullion" means precious metal, including gold, silver, platinum, rhodium and palladium, that has been smelted or refined so that its value depends on its contents and not on its form.

    Example where tax should not be collected:

    Question: I purchased a used set of golf clubs over the internet from an individual in Connecticut. The seller shipped them to my home and did not charge me any tax. The individual is not in the retail business. Should I report these purchases?

    Answer: No. Items purchased for use in Arizona from individuals making isolated or occasional sales, and who are not engaged in the business of selling tangible personal property at retail, are not subject to use tax.
