Wacky seller - the dispute begins. Like watching a traffic accident in slo-mo.....

Recently bought a set of roosevelt dimes on ebay listed as ALL uncirculated. Here's the text from the ebay listing:

HERE IS A COMPLETELY FILLED ROOSEVELT SILVER DIME BOOK. ALL DATES ARE FILLE IN AND ALL COINS ARE UNCIRCULATED, VERY NICE FIND INDEED. 49 TOTAL ROOSEVELT DIMES HERE AND A WONDERFUL COLLECTION FOR AN INVESTMENT. SILVER IS A SAFE HAVEN FOR INVESTORS IN AN UNSTABLE ECONOMY. WILL START AT .99 AND THANK YOU FOR YOUR CONSIDERATION

Here's seller's return Policy from the ebay listing:

Return policyItem must be returned within: 7 Days

Refund will be given as: Money Back

Return policy details: IF YOU FEEL THIS IS NOT AS DESCRIBED HERE I WILL TAKE BACK

When received, the set had 8 uncirculated coins and 40 circulated (those coins were cleaned and polished - nice & shiney). Here's the email string with the seller so so far - what do you think (entire exchange below happened inside of 3 hours):

Dear seller,
Received this item today. The set is not uncirculated. In fact, the only dimes that are uncirculated are the 54S, 55S, 59P, 60D, 61PD, and 63PD - 8 out of 48. The rest have been cleaned and worked to make them appear shiney. Please confirm back via email and I will get them back to you ASAP for a refund.

Here we go again. Thesimple fact is with Ebays new rules I have no other choice. I do not beleive there cleaned and you obviously are one of those people who is hoping to get a whole lot more than you actually paid for. Either way your going to giv me a neg.,,let me ask you, what do you think you would pay if you bought these at a coin show. Ill tell you how much, 150 -200. Ive discovered in my time on Ebay that people sometimes like to "try stuff out and if they didnt hit a home run. there like, screw the seller, has HAS to take this back"

I will take back under the follwing conditions: I am not refunding shipping either way, I get a 10% restocking fee and we agree to a mutually agreed to commitment so I dont get hit with Ebay and Paypal fees. OH...ps, I dont need to hear how long you have been collecting and your whole resume of your coin collecting life like people so often do here on Ebay. Bottom line is you thought you got a home run paying a singles price.

You seem to have a rather large ebay chip on your shoulder but that's not my problem. Bottom line, the set was misrepresented and I know the difference between uncirculated and circulated. We can do this the nice way or the ugly way. I prefer the nice way. Here's how the nice way works: 1. I will send the set back. I will pay for it. 2. You will refund 100% of my purchase price via PayPal (that's how I paid). 3. You can file a NPB on ebay to get back your selling fees, saying I returned the item and you have refunded my payment. I will agree and ebay will return your selling fees. 4. Do the above, and I will leave positive ebay feedback. And we both move on. I think that's pretty fair. Please confirm and we can get this done.

Look I have already had one psychotic give me 11 negs because he was sure I was part of the CIA and looking to OUT him from his covert position. Do you think one more is going to matter after that? I have a chip against people like you always looking to only pay half of the worth of something and when they dont get it they scream like a stuck hog...just like you. Oh and heres what else you will do. You will pop superior coin and fill it with junk and say thats what you got. Its happened to me before on Ebay, not this time. I am sick and tired of dishonest buyers screwing me over and not being able to do a thing about it. I sold a Barber quarter page and the guy popped out the most valuable coin and stuck a slug in and thats what he said he got. Forget it, Im on to you people.

Nice, huh? So I've opened a PayPal dispute and immediately moved it to a claim where PayPal interceedes and makes a determination. There's no way I'm going to be able to work with this seller directly given the above. This is my first experience with using the PayPal claim process (item significantly different than advertised). Ever been down this road and how did it end up?

    In some communities it's against the law to hang one's laundry outside to dry (this is fact).
    The seller has contacted the producer of this show, and as a result of this post you will be contacted and asked to stay at the Dr Phil house with this guy for a whole week. (this is fiction)

    God, what an assbag. I had to deal with a seller like that once -- he actually refused the package I sent back to him. So I then had to file a SNAD and he caved and gave me a refund (after which I sent him his POS coin a SECOND time).

    This buyer seems even worse, but I cannot imagine ebay denying the SNAD.

    By the way:

    If the seller is a PITA every step of the way, I would neg him, even if Paypal approves your claim.

    I ended up leaving NO feedback in my situation, as I did give the seller credit for doing the right thing once the SNAD was filed.

    What amazes me about the auction is that the seller relies on eBay's lousy photohosting service, with small images of the dimes, and that it got any bids above and beyond bullion value for the coins. Going on the photographs only, because I never believe seller BS anyway, I wouldn't have bid on them in the first place.

    With his high feedbag number, but numerous neutrals and negs, I think I would have researched his feedbag before I bid on these, even at bullion value.

    But the deed is done, and I think you owe it to this fool to give him his desserts - a big fugly negative comment.

    I hope this works out for you. I definitely won't be buying from him. Seeing the seller's listing style reminds me of someone, although the seller's grammar is better:

    I am very sorry for you. However this line alone made me laugh out loud, what a NUT!!!! Reading the email exchange, it sounds like he is either having a really bad day, or he has done this many times and hopes the buyer will cave. This is a prime example of why sellers can't neg. Given the option, this guy would neg everyone of his customers. What a sick and twisted individual.

    The seller is delusional if he thinks a circ set of Roosy's (with 8 uncs) is worth $150-200....that's 2-1/2 to 3X scrap. I'll be nice and send him a complete circ Roosy set for $100 if he wants to try and flip it for $200 on ebay.

    Yes sir. Same thing a set of roosevelts that was described as uncirculated by the seller. When they arrived some of the coins were as low as VF. The only difference was, and this is big compared to yours, is that the seller did not want the set back after I contacted him. He shot me a email and asked what I would pay for the set. Since it was in a capital plastic holder I gave him melt value plus 25 bucks and everything was cool.

    My seller had a brain. Yours does not.

    If you view the item, it ended on 4/14 (Monday) yet the neg was left on 4/23 (a week and two days later).
    Additionally, the seller appears to use the same picture for different coins.

    Specifically:
    this one is the same as this one. Here it is again!
    And yet one more time!

    I'm always a little leary of stock photo seller for raw stuff since they ALWAYS claim that you returned a different coin when you see that the picture and actual item are not the same.

    For the OP. Good luck with your dispute and get ready for some spiteful, hateful emails. Hopefully you used a PO Box as I'm certain, if you didn;t, he's going to threaten you since he knows where you live.

    Seller like this are the ones that got this whole feedback business started. They simply have no business selling on eBay as they sell through nasty intimidation!

    I decided to change calling the bathroom the John and renamed it the Jim. I feel so much better saying I went to the Jim this morning.

  • from your story the seller sounds like a complete tool, HOWEVER i am wondering why when i look at the pics, i see (for the most part) circulated coins. did the picture not show up for you ? if you could not see the pics did you ask the seller for better pics, did you ask the seller if the coins pictured were the ones you were bidding on ? ? i seriously doubt that the seller knows the difference between unc and cleaned circs. couple this with his story of being screwed before and i see how the whole situation could have been avoided. are you wrong ? is he wrong ? to me it looks like he cant grade coins and you should have looked at the pics.
  • add to that, it looks like only the first two bidders looked at the pics, they ducked out when the bids were higher than the value of the coins. even with the small size pics its quite obvious that the coins are mostly circs. if you cant find a middle ground with the guy, chalk it up as a learning experience and learn from it. you will be better off to learn something than to "get him"

    The seller stated that the coins were UNC. In other items he states they're "flawless". When is the seller going to hang by his own petard?

  • lets face it, sellers dont always know what they are selling. this usually works in favor of the buyer, but with pics like that its quite obvious the coins are not UNC no matter what the guy says

  • im not questioning the guys return policy, the question i posed is am i the only one that can see from 300 feet away that those are not UNC ???????? i dont care what THE SELLER calls them, i bid from what i can see, and i see a $50 set of dimes. my point is, that if the buyer would have looked at the pics, then he may not have even bid and therefore would not be in this situation. an ounce of prevention is still worth a pound of cure. my not be what the buyer wants to hear but it is the way it is

    Filed claim on a non-receipt of 2 10oz. silver bars. "Powerseller"image now banned. Sent e-mail 1 to seller thru ebay, then 2 message claims thru paypal and called paypal on phone, to make sure there was a record.Paypal refunded over $400 Just be civil and stick to only facts. It will most likey end with you returning coins at your expense and getting a refund. Paypal puts a hold on seller funds til claim is settled.

  • Just goes to show you.......... READ the feedback BEFORE you bid. At least then you will have an idea of who you are dealing with. Does it come as a surprise to anyone that he reacted the way he did to the OP after reading his previous feedback?

    Seller is definitely nuts. But, from what I read, he was not happy that your communication with him was via regular email and was not thru the Ebay email system. A nut like him should be glad that his stupid communications with you were not available to the Ebay staff.

    In my Ebay transactions, if I think I am going to have trouble with another EBAY member, I always use the EBAY email system to communicate with the other Ebay member. This way, if necessary, the Ebay staff can go back and review our communications.

    The guy has a huge bad attitude about the new feedback rules, not unlike many posters here. You deserve commendation for handling it well. Keep it up and maybe you can drag him out of the ditch.

    I notice you won it at open auction--not like you lowballed him as one of his e-mail implies.

    it was obvious from the pics only a hanful were uncirculated.
    this is exactly what i mean about auctions turning into walmart
    purchases. i would have bid melt but others prefer to take the
    BIG RISK and then get upset. It was also obvious the seller
    was a dork from the auction description.
