Issue with Ebay card won

I won a card on Ebay a few days ago for the opening bid of $5. I have seen 2 others like it listed with Buy It Now prices of $50 and $79, the $79 one is still listed. I paid through Paypal immediately after the auction ended but I had a feeling that I would never get the card. I never got an email from the seller until yesterday but did get positive feedback. The following is the email I fot yesterday, 5 days after the auction ended. What would you do? I haven't responded yet.

I am so sorry to tell you that I can not find this card. I have looked everywhere. I can not imagine what happened to it. I am going to give you a full refund and if it appears I will mail it to you for free. I am terribly sorry. I am sorry for any inconvienence.

PS - give us a link to the auction if you don't mind.....
I would argue against the neg simply because there's no way of knowing if he's lying or not at this time. Keep an eye on his auctions and weigh your options in the future if he relists the same card. Don't leave any feedback, maybe he'll relist it before time to leave feedback runs out.

I personally don't leave negs unless I know I've been ripped off.

Let's face it, a guy whose card selling consists of a few Rhett Bomar (who?) cards, isn't very used to dealing with cards. He may have honestly laid it down somewhere and can't remember where. And since he listed it once and it didn't sell for the $5 opening bid, he obviously knew there was a good chance that it would sell for that if he re-listed it.
In this case, and in the spirit of Christmas, I'd give him the benefit of a doubt.

I would bet , he actually misplaced card, I have done this a few times with cards,coins or whatever, luckily after tearing the house apart, I have always found them within 48 hours of the auctions ending.
He is a top rated seller with what looks like an average of 50 to 60 items selling a month, I would also bet if he finds the card you will get it for free.
He will remember that you did him a favor by not giving him a Neg & dinging his stars, mistakes happen & things do get lost especially this time of the year. jmho

I think the card is numbered to 15. I really like those Donruss sets, I think they did that two years in a row. I have a couple of the 2000, a nobody rc /22 and a Tony Gonzalez /can't remember.
Raw: Tony Gonzalez (low #'d cards, and especially 1/1's) and Steve Young.

The card is serial numbered to 15. All the cards in that set are serial numbered to a players stat. Terrell Davis is the is the shortest print card with only 5 cards produced and Barry Sanders is the highest print with 86 cards produced. There are 25 cards in the set. I still need 5 or 6 to complete the set. Burbank Sportscards has/had a couple listed that I need but they were WAY overpriced.
