How long do I have to file an INR claim?

Is it 30 days or 45 days?

This is an EBay purchase. The seller is still communicating with me, but long story short I'm not particularly optimistic at this point that I'm ever going to see these cards. I don't mind giving him some more time to make good, but I don't want to miss my window to file, either. Today was day 25.

    If it's a US to US delivery then 25 days has been too long. Communication is nice but has the seller provided proof of shipment and tracking information? Check with your PO to make sure they don't have it and then file the INR. If you or the seller is outside the US then 25 days isn't cause for panic yet. If the seller can provide proof of mailing then I'd say you're okay with giving it more time. If there's no proof of mailing then I would be quicker to file.
  • I completely agree that it has been too long; I am just trying to give the guy the benefit of the doubt since he is still keeping the line of communication open. I am generally very lenient as a buyer about shipping time as long as A) I actually do get the item, and B) I'm satisfied with it when it arrives. I didn't contact him at all until day 18/19 or so.

    I have asked him twice if he has a tracking # for me, and he has not provided one.

    It is a US seller (same state, in fact).

  • If he has not/ does not give tracking info and you are geographically close I would go ahead and start the process. Does his DNR rating show a very slow shipping average?

    He seems to have a decent (although not flawless) seller history, but most recent sales were in February of 2009. So no DSR ratings to check.

    I don't want to escalate this unless I absolutely have to- if these cards are as nice as they appear (it's a small lot of high # 71's), I REALLY want them. image

    Walter!!! What on earth are you thinking??? TWENTY FIVE DAYS...c'mon, your deal ain't gonna happen. I give a seller 10 business days, then communicate, if no response, or a weak one, I'm on the horn to eBay pronto. If the seller shipped the goods he should have been able to provide shipping info. Regardless of how badly you want the cards, enough is enough. File, win, get your coin back and move on.

  • Yeah, I suppose you guys are right. I'll give him another day to respond to the latest message I sent last night, and if he doesn't respond- or responds with anything less than the tracking #- it's INR time.

  • Playing devils advocate: I did a deal with a dealer lived 35 to 40 miles from me, I sent product he was to send check. waited a week no check called and asked if he had sent it, he said yes gave him another week. called demanded a check, he sent replacement ck arrived 2 days later. 17 days later or a total of 31 days original check arrives postmarked the day we did the deal.

    Had UPS lose an item I shipped, 64 days later the guy I sold it to got it.

    crap happens, ask the dealer to refund your money and if cards show up, pay him.

    I think it is sometimes easier to deal directly with the person (email/phone call) than escalating it to a paypal claim, but you do have 45 days to file a claim, if it is a large amount of money file a claim today.
