**Pack Fraud Alert: A new run of counterfeit vintage wax packs now on ebay!

Two 1970 Topps basketball wax packs. Ebay listing# 400113627211

Currently on ebay there is a whole new run of vintage wax packs listed by (derek9308). Ebayer (derek9308) is none other than well-known pack counterfeiter (pastoney) who is also known by the ID's (tarheels17032) & (hunter17045).

All four of these ebay user ID's were using a fifth user ID (codyemma17) to exclusively purchase the raw wrappers, high-grade singles and empty wax boxes to construct their counterfeit vintage wax packs. Over the last year I was successfully able to get (pastoney), (tarheels17032), & (hunter17045) kicked off ebay by supplying ebay with undisputable proof that these three ID's were constructing their packs from wrappers won by (codyemma17). But to my frustration in each case ebay would kick off the seller ID and do nothing to (codyemma17).

Finally a month ago I sent undisputable evidence to ebay that yet a fourth ID (derek9308) was using this same ID (codyemma17) to buy his ingredients to produce counterfeit packs. And after 10 months ebay has (finally) kicked off (codyemma17).

But sadly (derek9308) is still listing packs on ebay so he has either created a new buyer ID to buy wrappers or he is using up his inventory. Nevertheless I am tired of tracking this person and his ever-changing ID's coming out of the Harrisburg, Pa. area. But suffice it to say you can rest assured this new round of vintage packs on ebay are counterfeit as well.

As some evidence of proof as well as a quick lesson for "newbie" pack collectors I chose this set of 1970 Topps Basketball wax packs (pictured above) currently listed on ebay by (derek9308) as an example on how to recognize one characteristic of a counterfeit pack--that being pronounced creases. If you look at the top pack you can easily see two pronounced creases running the entire length & width of the wrapper. This indicates the wrapper at one time had been folded entirely in half, and then folded in half again.

Obviously this can only have happened when the wrapper was in a raw state with no cards inside. Being such an obvious sign of this being a counterfeit pack I am surprised such an experienced counterfeiter would choose to use this wrapper. Nevertheless be cautious of any waxpack whose wrapper exhibits creases that look to be "man made" as opposed to "machine made".

I'm not sure if you noticed this, but his eBay listing mentions he's not selling them as unopened:

"Up for auction are 2 1970 Topps basketball wax packs. This is part of a large selection of packs that a friend of mine recently bought at a sportscard auction. Please note, I am NOT selling them as unopened as this is how they were bought and how they will be sold, as is. The packs are sealed but your eyes are the buyer. Any questions I'll be happy to try and answer."

The way it's worded sure sounds like he knows they're not legit ... "part of a large selection of packs from an auction, ... bought by a friend of mine, .... sold as is, ... The packs are sealed, but your eyes are the buyer." (That's my favorite line in there!) lol

I agree the packs look bogus, and he's probably fishing for a sucker. However, if he's disclosing it in the auction .. unfortunately, I don't think that's technically eBay fraud, is it?

Keep up the good work though, and stay on top of all those Ebay ID's .... it's hard to keep track of the counterfeiters changing identities all the time. There was a guy that drove me crazy a few years back that had flooded eBay with bogus 1973, 1974, 1975 Fleer Football packs. He was so brazen, that he started including cloth patch combinations inside his packs that weren't even possible.

  • Thanks shouldabeena10,

This is simply a new sales tactic to steer any responsibility away from him. Also notice the use of a 3-day listing to quickly move these packs.

There is a core group of sellers right now on ebay that are systematically flooding the market with fake and fabricated packs.

  • Forgive me for threadjacking, or for potentially slagging a respected boardmember, but there are some packs up on ebay now from probstein123. He has impeccable feedback so I was wondering if anyone has any info on this person.
    Thanks very much.

Rick Probstein has always been a good seller in my dealings with him. Never bought packs, but he's been around a while and I would think he'd stand behind anything he sells.

Always looking for Topps Salesman Samples, pre '51 unopened packs, E90-2, E91a, N690 Kalamazoo Bats, and T204 Square Frame Ramly's

Agreed, Probstein is top notch. Bought a lot of unopened 80s from him at one point and it was all legit. I think he's been selling off his stock from back in the 80s and 90s when he was a serious player.

I've bought many packs from Rick before without a problem...the ones that are ending tonight don't look as appealing as some of his others, but as Anthony said, I believe he will stand behind what he sells.

    Authenticity Disclaimers

Sellers may not disclaim knowledge of, or responsibility for, the authenticity or legality of the items offered in their listings. Sellers should take steps to ensure that their items are authentic before listing them on eBay. If a seller cannot verify the authenticity of an item, the seller is not permitted to list it.

The following statements violate eBay's Authenticity Disclaimer Policy:

"I cannot guarantee the authenticity of this item, so please bid accordingly."

    "Vintage Handbag Chanel???"

“Looks like it could be a Louis Vuitton bag”

“I believe this is painted by Degas, but can’t be sure.”

Violations of this policy may result in a range of actions, including:

    Listing cancellation

    Limits on account privileges

    Account suspension

Forfeit of eBay fees on cancelled listings

    Loss of PowerSeller status

    /////////////////////////////////////////////////////////////

    Not Allowed

Confusing or unclear titles or subtitles

    Incorrect or inconsistent information

    Incorrect or incomplete information

    Misrepresenting the item for sale

IF it is "proven" to EBAY's satisfaction that the CRIMINAL
is a serial bad guy using multiple IDs, he will eventually be
    shut down.

While the SCUM's weasel words are interestingly crafted,
they would not survive proof that he "knew" the packs
were reseals. His buying accounts showing the purchased
wrappers would void the disclaimer as "incorrect."
