Upper Deck-"NOT Authorized"

Well I picked up a couple of 2010 packs today and noticed something I guess I knew about, but never gave much thought about. Since UD is not authorized by MLB or the ML Teams, how are they getting away with using the Team Logos and images? I noticed there is not really a full pict of these images, just partial. Also noticed the small mug shots of the players faces are zoomed in on to cut out the hat logos. Out of the two packs I bought only SB-63, a biography insert card shows the full "T" on the Rangers hat he is wearing. Do they have to state on the front of the packs that they are "NOT Authorized"?
Just as an observation, isn't this the same design UD has been using every year for the past 10 years, full color shots with the foil UD logo in th top corner? Guess this is why I stopped collecting 5-6 sets like I used to; price and lack of design.

  • There is a lawsuit in court over this. MLB sued upperdeck for trademark infringement and asked for an injunction against upper deck selling the product.

It would be nice if there were only 2-3 companies left.

But then you still have the problem of those 2-3 companies issuing 10 sets, kind of like Topps does now.
I guess the pending lawsuit didn't keep UD from moving forward. Was this an old lawsuit or is it something new this year? Gosh, remember the old days when they air brushed the hats and shirts?

How do liars and thieves get away with the things that they do?

    Good for you.

When they airbrushed hats and shirts they still had a license with the players association.

The lawsuit was filed very recently.

I am curious as to how many others feel this way?

In broad buckets, I look at the hobby as 3 stages.

    1. The early days when you had one, or a few, choices... from the 50's to the 80's.

    2. The peak period where you had a dozen or more companies making cards... the mid & late 90's.

    3. The current period where we are back to few manufacturers, but each of them making numerous products. It seems there are low end products and high end products, with little in between... every box seems to be a lottery to me.

Personally I miss the peak period with all the selection, innovation, and lots of mid-range offerings for your ripping dollar.

  • I agree with 2 or 3. I'd also like to only see 2 or 3 issues per company per sport, per year. Right now it's madness.

It is cheaper to wait 4-5 years and wait to see which cards are the heavy and then buy them.
  • The problem with waiting a few years is that alot of good signature cards are redemptions
    and they would have expired.

Ya, all good points. I stopped ny my local card shop today and spoke a bit about this whole thing. Seems Topps will not be making football next year, as UD (I think) has the sole agreement. The NBA is going in the same direction. I don't know, I just wish I didn't have to pay $3 a pack for some crummy product launch that will never hold any value, or (more likely) I will end up with tons of sets that I can never finish because of all the crazy inserts and SP's. As a set builder, this seems to be an obsession with us. Oh well, I got 2 Jumbos of Topps Series I and a half case of Heritage coming. I am feeling confident I'll finish the Yopp Series I but even with $380 of Heritage, I vwill have to dish out another $50-80 to buy the missing pieces. Oh the life of a card fanatic.

I know, no mercy here, we're all in the same boat...
