I'm no lawyer, but if more cards like the one in this auction start showing up, I'd think that PSA might have a case against whomever is creating these flips.

PSA could probably have a trademark infringement case depending on how they have filed the description of their flips with the government. However as usual it is probably not worth the time or effort of a one off case. Of course if "Mint" grading takes off it may be a different story.

There would have to be irrefuitable proof there was an attempt to defraud.
This may be a case of buy the holder - not the card.
