Should I neg or should I go...

Note: Edited a couple of details about the auction because as I looked back, I was slightly off on one or two details.

Bought a pretty hi-end card a few weeks back. Here's the auction (actually it is one of the few buy it nows I've ever done).

-Payed instantly on 10/15
-Seller has 5-6 business days for estimated delivery in his own shipping terms. Shipping=$10
-I send the seller an email after 3 days asking him to let me know when he's shipping so i can keep an eye out
-He says he won't be able to get to shipping it until 10/25.
-He notifies me on 10/23 and tells me he's leaving town and won't be able to ship it until earliest 10/29
-I immediately file a PP dispute
-he cancels the transaction
-I tell him I'm not canceling anything until I get a full refund
-get a full refund after escalating to PP claim

I'm so tempted to not cancel, make him eat the fv fees and neg him. On the other hand, i got my refund quickly. For all the griping about bad buyers, there are still sellers that continue to amaze me. Spend ~$3K on a card and it's gonna take 2 weeks to ship/3 weeks to receive; meanwhile, no proactive communication in the interim.

Let's take a vote. Who would neg vs. who would cancel and let it go?

    All I can say is if I spent 3k on a card I'd expect it to be in the mail the next day.

    technically you aren't out anything but your time wasted, however this is not how he should be treating buyers, and other buyers need to know about it.

    No excuse for three week shipping....neg stating this. Got all your money back....only because paypal held it for you! HOw long, if ever, would have taken if you had to wait for him to grow some integrity?

    I would probably give him a neutral. You got your money back OK but it was a very slow transaction, which just isn't acceptable for something in the $3K range.

    If you NEG him, put him on your BBL.

    If you type "Don't Agree" in the Mutual Cancellation Panel,
    he will lose his FVFs. (OTOH, EBAY will get free money.)

    So many horrible people, and genocide is illegal.

    And as a Seller, I can guarentee you the card (1K-5K) will be in the mail to you the next morning, even if I have to take a Half day off work to make that happen.

    thanks for the thoughts. When I sell, hi-end cards go out immediately, sometimes same day. Hard to believe the level of service here.

    i've had to escalate two claims to PP in the past month (won on both) on sellers of hi-end cards who refused to deliver. really starting to piss me off.

    Is there a chance the seller wanted to cancel because ending price was too low? Is it possible there is a problem with the card an experienced collector would see with card in hand and the seller is looking to sell to a newbie or someone easily fooled? Who is this gentleman, so I can avoid him?

    BTW I failed to say the seller definitely deserves a neg. Having said that I would ignore and not deal with again as that is what I have done the last 10 years on ebay. I am such a wimp.

    I would neg the crap out of him.you agreed to purchased a product regardless of price and he didn't deliver. End of story.

    It definitely was a negative experience.

    Why is it that the seller couldn't find the time to contact you to let you know that your card would be mailed so late? ...... yet he instantly found the time to reply once you filed a complaint?

    This always happens with buyers, too.

    I agree that the seller's 5-6 days for receipt policy was not just too damn long to begin with for a $3,000 card, but it was also ignored.

    Ralph (Brick) could be on to something here regarding the seller possibly not wanting to sell for the selling price!

    Unless the seller had one heck of an excuse and offered some kind of extra compensation for unacceptable service, I feel a negative is in order.

    As Storm advised, be sure to put him on your BBL list!

    How did the experience impact you? It sucked............. unless there are circumstances he related to you that do not warrant a negative, i think you have an answer.

    It's possible that since the card has been for sale for more than 4 months, that he can't find it?

    I would file an ebay complaint about non-performing seller, neg him and move on. He's had the time to list 4 items in the last 4 days, one a bike for over $40K with lots of pictures. He's blowing you off.

    I wasn't feeling so charitable so I hammered him with negative feedback. That, and he left me "bad" positive feedback (which then eBay removed). <sigh>

    edited to add: I blocked him and moved on. Times like these I appreciate the buyer protection on paypal because one way or another I was going to get my money back.

    Between the horrible listing and the seller's actions, just be glad you got your money back without an extended fight.

    I agree with you.

    Two years ago , I had a member here on these boards, that mailed the card out 16 days after I paid for it. It got lost and the BS began. I got no card nor any money back because it was a MO. The guy could only do buisness on Saturdays , because he had a jobimage.

    You know that there are people that believe you can pick up a turd by the clean end.

    As a general rule of thumb, you should never buy cards from sellers who use more than 3 font sizes in their auction description.

    neg because paypal gave you your money back, not him. if he honestly couldn't get the card to you for some reason and returned your money, I'd not leave feedback.

    now that you have your money cancel the transaction and let him have his money back. good luck
