Greetings. I currently have on eBay a 1993 SP Derek Jeter PSA 8. The PSA serial number for the Jeter is 40446437. Here is the image:

While surfing eBay, I came across another auction for a 1993 SP Derek Jeter PSA 8. The seller, contractor$, has stolen my image. Here is his image:

I can guarantee, with absolute certainty, that the seller, contractor$, is not in possession of this card. I have already reported this auction to eBay and I recommend that you not bid on this auction as, if you are the high bidder, you will not receive the card pictured. Thank you.

There is a lot of confusion about the recent "changes"
in image-use policy.
EBAY's TOS have ALWAYS outlined EBAY's contention
that they could use any image on their site for any
lawful purpose. The "changes" were simply designed
to perfect that contention.

In this case the card has a cert number and that number is important.
I guess they feel it is similar to a CD players manufacturing number? Where all cd players are the same?
This can get really ugly. I wonder how SNAD will be effected?

IF there is no disclaimer like,
"You will receive a card similar to the one pictured.
You will not receive the exact card pictured,"
a SNAD-claim would likely be decided in favor of the buyer.
........
I really doubt that many sellers will use "stock photos"
of graded cards.
