Fraudulent Auction: Stolen Image Of My 1993 SP Derek Jeter PSA 8

Greetings. I currently have on eBay a 1993 SP Derek Jeter PSA 8. The PSA serial number for the Jeter is 40446437. Here is the image:

While surfing eBay, I came across another auction for a 1993 SP Derek Jeter PSA 8. The seller, contractor$, has stolen my image. Here is his image:

I can guarantee, with absolute certainty, that the seller, contractor$, is not in possession of this card. I have already reported this auction to eBay and I recommend that you not bid on this auction as, if you are the high bidder, you will not receive the card pictured. Thank you.

Didn't ebay recently start the stock image thing. Where if an image of an item is already in the database, a seller can use it?

its not Fraud -- ebay can use your images now without your permisson as stock photos , unless u opted out of this.

did you ?

If not , I bet he is using the stock photo.

I did opt out. Regardless, however, the high bidder may receive a 1993 SP Derek Jeter PSA 8, but it will not be the card pictured.

If the photo is a "stock" photo (you may not have opted out even though you claim to have) then you are being a little defaming in your contention that the auction is "fraudulent" and that the image is "stolen." While I understand your frustration, I am still amazed by how quickly people throw around such allegations.

ANY image listed PRIOR to a seller having opted-out
can be used by EBAY. Such images are NOT removed
from the free-to-use file when a seller opts-out.

There is a lot of confusion about the recent "changes"
in image-use policy.

EBAY's TOS have ALWAYS outlined EBAY's contention
that they could use any image on their site for any
lawful purpose. The "changes" were simply designed
to perfect that contention.

IMO ebay should not allow a picture of a specific item.

In this case the card has a cert number and that number is important.

I guess they feel it is similar to a CD players manufacturing number? Where all cd players are the same?

This can get really ugly. I wonder how SNAD will be effected?

IF there is no disclaimer like,

"You will receive a card similar to the one pictured.
You will not receive the exact card pictured,"

a SNAD-claim would likely be decided in favor of the buyer.

........

I really doubt that many sellers will use "stock photos"
of graded cards.

The auction for the other Jeter ended. High bid was $85.01. You are right Steve. I am not going to concern myself with it and let the buyer worry about it. The buyer may receive a 1993 SP Derek Jeter PSA 8, but it won't be the one pictured.

I am OK with using a stock file but there is no way you can use a stock file with a cert # or any type of serial number and not CLEARLY state it is a stock photo. Plus Ebay should set all stock photos used with a small banner across the image stating stock photo. Then no one should have any issues.

I wonder if eBay would use your pictures as stock photos if you put in a watermark with derogatory sayings about eBay on all of your pictures and didn't opt out.
