I just saw the story on Yahoo.

I hope Topps wins. UD should make their own classic designs rather than stealing it from Topps.

Upper Deck did that before in using Topps 71 design for one of their sets and also the 65 design if I remember correctly

That's from an OPC subset and UD owns the license for OPC. Wonder why the article doesn't mention that and what kind of defense that will give UD

You sure about that? I always thought OPC was a rebranded Topps product.

they acquired it a couple years ago - don't know the details but they do own it
  • I always thought that Topps had a deal granting OPC the rights to the designs for their Canadian set. If that's the case, then the designs were (and still are) Topps' property, and even though UD has started using the OPC name on their cards, it wouldn't give them the rights to use any previous OPC/Topps designs. I'm not anti-UD, but this is design theft, plain and simple. But then again, I never understood why Topps didn't hit them a few years ago when they used the '71 and '65 sets for UD Vintage...

Topps' first attempt to stop distribution of the cards has failed in court.

Interesting info (circa 2/09) in The Beckett Blog about UD and them copying the '71 Topps/OPC design:

They did the same thing with the Upper Deck, O-Pee-Chee hockey. They did a parallel set using the 1979-80 design.
