Should I file a paypal not as described claim?

I recently purchased a SLU favre figure and it was nothing like the condition stated in the auction upon shipment to me.
Seller response is below.

Refund is subject to his inspection. This sounds like a little BS. Should I file a claim with paypa just to be safe?

Wow, didn't know my MINT description was so off. There was absolutely no tear on the back or dents on the bubble when it was shipped. I will be happy to refund when I receive it and examine it. Please ship to:

    Probably.

    You will have to pay return shipping, no matter how you handle it.

    Save the packaging materials, it sounds like he's going to try to blame the shipping company as it was perfect when he sent it and now it's junk. Everything is perfect when it's shipped.

    I filed a SNAD once when I received an item that was horribly packaged. The seller blamed me for not buying insurance, and in my reply I mentioned that USPS would not pay a claim on that damage because of inept packaging.

    You'll have to pay shipping back and MAKE SURE you use Delivery Confirmation!
