I am not sure of the correct things to look for on grading these but.........my opinion it might be even higher than you suggest.

I think EF is appropriate... I think 40 is fair but 45 may be a stretch

Crown looks good but 'wear in the hair' brings it down from XF to VF+ imo.

I agree with ZAR. The hair will keep it from XF

There might also be something on the rim at 9:00 on the reverse

Color looks a bit off, to me. I would guess VF 35.

Yes, there is a very minor rim nick at 9:00 on the reverse.

I say it's an easy EF40 and probably a 45. The X's in the crown are full, the scalp line at the top of fore head is distinct, as is the end of the ribbon on the neck. Nice coin.

Definately xf on obverse, but to much wear on the hair to be xf, IMHO. Still a nice coin. Love Miss Vicky.
