Usually so.
If you collect it, you need to be sure to send it along to the state.

keep the money, im fairly certain your state government doesnt deserve it, or will misuse it. better in your pocket than someone elses.

If you have a sales tax ID then yes you have to pay it one way or another. The actual laws vary from state to state though on the process.
If you do not have a sales tax ID and are collecting it you are breaking several laws in most States.
