February 12, 2008 -- Andy Pettitte Andy Pettitte was excused yesterday from testifying against his friend Roger Clemens Roger Clemens at a congressional hearing - but it appears Pettitte already has done plenty of damage to Clemens' contention that he never used steroids or human growth hormone.

Rep. Tom Davis, the ranking Republican on the congressional committee investigating steroid use in baseball, told Newsday that Pettitte, in his deposition last week, backed up the account of Brian McNamee, the former trainer of Clemens and Pettitte.

McNamee has said Clemens used steroids and human growth hormone.

Davis told the newspaper that Pettitte's testimony matches McNamee's in most details, but that Clemens, in his deposition last week, said both of them are mistaken.

Pettitte asked to be excused from tomorrow's congressional hearing so that he would not have to testify against Clemens, and the committee's leaders granted him his request. They also excused Kirk Radomski and Chuck Knoblauch from the hearing, and Radomski from giving a deposition today.

That leaves Clemens and his accuser, McNamee, in a showdown tomorrow. They will be joined by one new witness, a member of former Senator George Mitchell's staff, Charlie Scheeler.

The move to excuse Pettitte, Knoblauch and Radomski came last night after discussions between the leadership of the House Committee on Oversight and Government Reform.

A source indicated to The Post that Pettitte verified a story McNamee told in his deposition about training at Clemens' home in 2002 with both Clemens and Pettitte. McNamee said that during a break, Pettitte said to him something like, "How come you don't give me the same stuff you give Roger?" indicating Clemens told Pettitte about his human growth hormone use.

Newsday reported that Clemens said in his affidavit that he spoke with Pettitte about medications, but not steroids or HGH.

One of Pettitte's lawyers declined comment when reached last night.

Rep. Henry Waxman (D-Calif.), chairman of the committee, and Davis (R-Va.) put out a joint statement announcing the removal of the three witnesses.

"Mr. Knoblauch and Mr. Pettitte answered all the Committee's questions and their testimony at the hearing is not needed," the statement read. "Mr. Clemens and Mr. McNamee have also cooperated with the Committee in its investigation."

Pettitte gave a deposition to the committee under oath on Feb. 4 that lasted for two and a half hours.

Clemens' lawyers said their client will stick to his denial that he ever used steroids or HGH.

"I think Andy Pettitte should do whatever is in Andy's best interest and whatever he thinks is best," said Lanny Breuer, one of Clemens' lawyers. "Roger Clemens is going to testify on Wednesday. He'll answer everything truthfully and forthrightly as he's done since the very beginning."

The committee can use Pettitte's deposition during the hearing and ask Clemens or McNamee about anything in Pettitte's testimony. It also will be part of the public record of the hearing.

Sparing him a trip to Capitol Hill appears to be a sign committee members believe Pettitte cooperated fully with their investigation, and that they do not need any more testimony from him. A source also said Pettitte was not a great witness in that his answers sometimes contradicted each other, and there was some fear of putting him in front of the committee with a national television audience watching.

    i can look at his body language and his eyes and tell hes lying thru his teeth-
    some buddy he had-saved needed foryears,shot up his wife to be in a swimsuit issue, i always though clemens was a great pitcher and player,guess hes gonna sink like bonds too if the story is true

    big difference between the 2....

    duke case was 1 whore spouting off.....the clemens case is CORROBORATED, and clemens is the only one lying...

    he could have avoided this whole mess if he said "i took hgh to heal when i was injured to get back to the team quicker"

    Clemens is not looking good at the hearings so far. His opening statement was forceful and strong, but he's not coming off well at the moment. He & Pettite have been teammates & friends for 9 years, but now "Andy misremembers?"

    I hope that McNamee gets grilled just as hard, and then we'll see who comes out better.

    Thinking about it , this guy could have indeed saved syringes , with Rogers DNA in/on it , what stops anyone from mixing stuff, in this case HGH after the fact ?

    I agree , Roger is getting grilled .

    haaaaaaaaaaaaaaa-good point- pun intended- rogers' wife is fine lookin though- i forgot about her on that cell-phone commercial till i saw her sitting there a little bit ago-

    As usual, right on the money, Storm. I wonder what the American people would think if they knew how much this investigation has cost the taxpayers. As usual, the big political gunslingers do their typical grandstanding. What a freak show. And, what will we get out of it that will actually be beneficial? That's a rhetorical question, of course. The only thing we should expect is a tough drug testing policy that includes HGH testing whether urine (future) or blood (now). I don't think the scapegoats, i.e. Clemens, Bonds, or the few dozen other MLB players are even remotely the tip of the iceberg. This was an epidemic and not only in baseball. The "unlucky players" are just the ones who either got caught, or accused. The rest of them were either too smart, used better masking agents, were lucky or "under the radar". If you think that the vast majority of players did not "dabble" in this stuff at one point in their careers, you're deluding yourself.

    And the irony in this whole mess is I bet the average baseball fan can't wait for the season to begin, baseball will have another record breaking year, and this sideshow will still be going on and on and on.

    RC says that AP "misheard" or "misunderstood" the comments that RC made.
    That is a reasonable explanation; I have no idea if it's true or not, but it is
    reasonable.

    Bonds bashers cite his "body morph" as proof that he was using. RC looked
    about the same before/after he was alleged to be using.

    Absent a confession, there is NO case against RC.

    Rose should NOT be banned any longer. He probably never should have been.

    Son, we live in a world that has fences, and those fences have to be guarded by men with gloves. Whose gonna do it? You? You, Senator Waxman?

    I have a greater responsibility than you could possibly fathom. You weep for Macnamee, and you curse me. You have that luxury. You have the luxury of not knowing what I know. That Macnamee's jail time, while tragic, probably will save lives.

    And my existence, while grotesque and incomprehensible to you, saves baseball as we know it. You don't want the truth because deep down in places you don't talk about at political parties, you want me on that field, you need me on that field. We use words like ERA, Walks, hit by pitch. We use these words as the backbone of a life spent defending our sport. You use them as a punchline.

    I have neither the time nor the inclination to explain myself to a man who rises and sleeps under the blanket of the very sport that I play, and then questions the manner in which I play it.

    I would rather you just said thank you, and went on your way, Otherwise, I suggest you pick up a bat, and stand at the plate. Either way, I don't give a damn what you think you are entitled to.

    To paraphrase from an article on espn.com:

    He threw his entire team -- wife, friends, agents, the commisioner, nanny, teammates, team doctors, everyone -- under the bus. And they all had to take it, because he's Roger Clemens.



    They should have nailed him on his lie about not know he was asked to talk to the Mitchell Committee. As you'll recall, he said on 60 minutes that his lawyers and agents told him not too. Now he didn't know about it? Incidentally, I remember reading either Gammons or Stark saying that everyone asked to testify was sent registered mail and that Clemens had signed for it.

    The Nanny/party lie and the lie about the discussion with Petite (He misheard me - I was talking about my wife???), are just obvious, horrible, indefensible lies. He was exposed as a liar, and while McNamee is a piece of trash too, Petite (and his wife) certainly swing the court of public opinion. I can't imagine any HOF voters buying into his lies.

    McGwire refused to talk about it and got 23% of the vote. Clemens lied like a rug - he'll get less votes. Maybe 15% his first couple of years. Same for Sosa, Bonds, Palmeiro and the rest. It'll be more interesting to see what the voters do 10 years down the road. Hard to keep these guys out. While the public has gone fickle on them now, they loved them in their primes (and their stats are hard to ignore). I'd love to see Rocket's bloodstained pants next to Schilling's bloody sock one day.

    McNamee's lawyer is now saying that he expects Clemens to get a presidential pardon from W. Honestly, that would not be surprising in the least.
