Burned by lelands ,whats my recourse?

I Purchased a 8x10 autograph of Mickey Mantle on a photo of his Topps 1952 RC card. Well today I recieved it and it has 2 considerable dents in the photo pushing out from the back to the front of the photo. this MAJOR flaw was NOT disclosed in the auctions description and a couple of other small issues like the edges not being so good and scotch tape on the back of the photo. the item was labeled NM-MT and is far from it. Now according to the rules of the auction it does state that all sales are final and no returns for any resaon. Do I have any recourse what so ever? I feel like I been ripped off and mislead. what to do ?

    I would first contact them and see what they say. Hopefully they will admit making a mistake accept your returned item and refund your money.

    Go have an attorney type you up a nice pleasant form letter that they will go after them for a fraudulent listing. Do you have a copy of the Auction description? Bring that with you along with proof of you paying for said item.

    If you paid with a credit card, you're in good shape. Talk to Leland's first, then your CC company if Leland's won't refund...

    Posting on a public board is a good first step. Raise as much hell as possible.

    I"m still waiting for a call back on a lot I won from them 3 years ago that was totally misidentified. I've talked to several others that have the same experience.
    About your only recourse is to add them to your list of auction houses to avoid. My list is getting pretty long.

    This is a rough hobby .

    It seems like every single time you turn around , someone is trying to burn you .

    You definitley have to stay completely aware .

    Seems strange that it is OK for places like this to get away with what they do time after time , but if you were to walk into their office and crack their damn head open with a baseball bat, you're the bad guy .

    So basically, they could have sent you anything and you would have to like it or lump it ?

    No returns for any reason? Just seeing that I would have never done business with them .

    I'd go with Mr.Carew29 suggested though, for starters .

    Thank you for the post though, at least we have a heads up and know to watch more carefully .

    I wonder why they hadn't contacted Mr. Griffins though about his situation ?

    Is it possible Mr.griffins, that you waited too long to contact them ?

    I am not surprised that Lelands did this. I bought 4 packs of '67 Topps 2 years ago that were graded by GAI. When I got them they were OPC. I called Leighton(then with Lelands) and quickly got a full refund--no problems. They do stand behind IMO.

    I would still give Lelands first shot.

    Tho they do have the policy: All sales are final. There will be no returns for any reason.

    They also state in this paragraph:

    FINAL BIDS AND SHIPPING
    For items that cannot be shipped by UPS (i.e. too large) clients are responsible to make their own arrangements to have their pieces shipped from Lelands' offices. We will supply you with the names of at least two shippers that we have had good past dealings with. Lelands takes no responsibility for the use of these services. There will be no returns unless the piece(s) are not as described.

    This piece is NOT as described and I think they take the return IMO.

    I don't care what any sellers policies are
    If they mess up
    they need to make good on their screwup
    Why should the consumer suffer for their mistakes

    I didn't catch that question.

    TNT - you can be sure that Griffins contacted them IMMEDIATELY - he's one of the true collectors here and on any forum he participates.

    Most all of these auction houses do some pretty questionable stuff from time to time.

    They're only happy if they get your money IMMEDIATELY - ship when CONVENIENT and receive NO calls from the buyers.

    The origins of a lot of these companies - even tho they gross serious money - is not of the best pedigree - if ya get my drift.

    I promise - you'll get a better - more professional response from Nabisco about the buck 2.98 box of cereal that you purchased than from these auction houses where you may have spent thousands of dollars.

    Some of these guys who started these big businesses are slick as snot and others? Let's just say - ya can't put a white shirt on a pig.

    Leighton Sheldon is one of the best in the hobby. Lelands lost an asset when he left them.


    Collecting 1970s Topps baseball wax, rack and cello packs, as well as PCGS graded Half Cents, Large Cents, Two Cent pieces and Three Cent Silver pieces.
