Ebay and Paypal claim...Need advice please.

I recently sold a PSA 10 card for a little over a $1000. Buyer files a ridiculous paypal claim saying the holder had been tampered with, but it has not. Naturally, paypal froze my account. There wasn't anything in there but account shows a negative balance. This tool also left two negatives which runined my 100% positive feedback. I currently have auctions running. I hate to end those auctions but I don't want to get paid with paypal and have more money sitting there until paypal decides my fate. What are the chances paypal with side with him and second how would you handle current auctions?

You have no proof that it wasn't tampered with and Paypal will usually side with the buyer. Basically, the guy's trying to steal from you. He probably cracked the card out himself and when paypal sides with him, he's gonna send back a cracked holder with a lesser card. Either that, or you actually sent him a tampered with holder. Can you provide a link to the auction?

I would say you're probably screwed and if you want to keep your money, you'll probably never to be able to use paypal again.

Let's look at the positive side. Maybe the guy just got spooked for some reason. I agree that Paypal will probably side with the buyer. The buyer will then have ten days to send the card back to you. As soon as you get the package from him, open it up and make sure everything is ok. If it is, then you got your card back, and he got his money back, and you have to start over and sell it again.

I would talk to a paypal rep and provide them with your scans of the card/holder. That's your only real proof that the holder was authentic. Of course, also explain the signs of tampering (ie. frosted edges) to paypal. BTW, your chances of winning a NAD claim are substantially higher if the buyer didn't go through a credit card.

Tough to say what you should do about the current auctions. Obviously, you won't get the cash if they pay with paypal, but paypal will credit the amount you owe them. From what I've read, paypal hires a collecting agency when people don't pay them, so you may not have a choice.

Hopefully, an attorney can explain your legal options if you lose the paypal claim. For that amount of money, I would go after the buyer if at all possible.

That is happening to my dad right now. He sent this guys some PSA 8 '58 topps and the guy goes on some rant about how they are tampered with and over graded at the same time. They aren't, I assure you. But as long as he packages the cards well and sends them back whole, then my dad doesn't really see it as much more than an inconvenience. But I am worried that the guy is going to pull something. It's such a a crock. It is obvious these cards aren't tampered with.

I'll PM the name. It's probably not the same guy, but it could be.

EDIT: It's not the same guy. But what's what with these people?

I just looked at the auction. The buyer looks legit...maybe he just got spooked as others have said? Or maybe this is his way of getting back at you for the shipping charges (which would be ridiculous, btw)? Scanning through his "feedback left for others," I couldn't see any other problems. I would try calling him and getting this resolved. I could be wrong, but I don't think he's going to pull a switch on you. If he does, document everything and sue his butt. Also, if possible, have a reputable witness (such as a postmaster) present when you open his returned package.

The shipping charges were two seperate auctions won about a week apart. I told him I would fix the shipping charge but he filed the claim immediately upon receipt of my email so no point in returning money then. Usually, I combine shipping on auctions won within 3 days. Plus he didn't like it when I told him about one of his auctions he was charging $10 for one card with no insurance. He has since changed that of course. Initially, he talked about sending the card to PSA but changed his mind and filed the claim instead. He also said he didn't feel the card was a ten which is more of an issue with PSA than me.

Sounds more like buyer's remorse than a scam to me. It sucks, but I would just try to get him to return the card. Paypal should get him to return it anyway before issuing his refund, but they can take forever to decide these cases.

Just make sure if he does return it you open it in front of your local postmaster so if he sends back something different or nothing at all you can easily have proof right there, they might can remove the delivered status from the DC.

Buyers remorse : Yes Idiot : yes : Put on Blocked buyers list :yes: will he win his claim: probably

Also look at feedback he has left for others there are quite a few items not as described or not mint.

Yeah, I did the toolhaus thing and saw that he had left a lot more negs than I saw just scanning through his recent transactions. The weirdest one was apparently a BGS 8.5 where he complained that a corner was dog-eared and the back showed evidence of copying??? Looks like the rest of the negs were for raw cards, though. Regardless, I would just get my card back and block the guy.
