How should I respond to this seller?

So I buy a small lot of '99 Bowman Chrome cards back on July 16th. Cards weren't much and I sent cash. Seller got the payment.
i still haven't received the cards. I emailed him stating I had not received the cards, please advise. His response:

"hi, i did send out your item first class mail about 2 weeks back and i have no glue why you still didn't receive it. i guess all we have to do is to wait for a couple of more days and see. hopefully it's just a delay. item is not insured and there is no way i can track it. i feel bad but there is nothing we can do about it. please let me know if something comes up."

Here's my problem with this--He charged me $3.95 for shipping and did not offer insurance. Now the whole total was $7.00, so to me anything under $10 is a crapshoot anyway, but his nonchalant attitude really ticks me off. How should I respond to this guy? Of course he didn't leave me feedback, so there is a chance of a retaliation from him if I neg him.

And to think I had hesitated on bidding on the cards, weighing the price against his feedback (98.2%), but bid anyway...

This will now make two auctions in the past two months that I never received the cards or compensation back on...after only 1 in my previous 10 years on Ebay.
Next MONTH? So he's saying that if he wins, the best-case scenario is that he'll be paying for it two weeks after the auction ends?

Forget blocking him; find out where he lives and go punch him in the nuts. --WalterSobchak 9/12/12

Sorry this happened to you yet again.

Even if he didn't send them with tracking, he more than likely has
the postal receipt which would show the day he supposedly shipped out your cards. Ask him for a scan of that. If he provides it, then he's probably telling the truth and the package might be lost in the mail. If he can't or won't provide the receipt of mailing evidence, then he's probably lying about it and just took your money. Either way it will give you something to judge him by and you can then leave appropriate feedback for him to warn other buyers.

I'd be shocked if he's even able to provide a postal receipt...

  • i had the same thing happen to me....took a little more than 2 weeks for a package to arrive......sure enough it was postmarked for the day the seller said he sent it......i would wait a few more days......

Wait 1 more week. Sometimes the phrase "I sent the item out 2 weeks ago, so I don't know why you haven't gotten it yet" is another way of saying "Oh crap, I totally forgot to send the item".

I've had a few cases like that, and in both instances, the item eventually arrived, but with a postage date 1 or 2 days after my "where's my stuff" email.

This is absolutely the sellers fault. He needs to have proof (Delivery Confirmation). One time a guy I sent a card to said he never got it. He had plenty of feed back and was 100% positive. Due to my carelessness I did not get delivery confirmation or insurance. I was SOL, I had to refund the money and ask the guy to be honest and return the money if he recieved the card (Mookie Wilson Topps rookie psa9). Anyway this guy owes you a refund if you dont get the cards in the next week.

That really burns me to hear a loser like that to hide behind the insurance card. Let me see if I understand insurance right; the BUYER is the one that must pay extra for it and it's the BUYER who supposedly gets burned if not bought. Yet the seller claims its for the SELLER'S protection even though they're not the ones that get burned on it, at least that's how most Ebay auctions are set up. Just one of my main pet peeves is all. Best way to go is to find a few really good sellers who sell what you like and stick with them whenever possible.

This situation is one of those times where it could be neither buyer/seller or both buyer and sellers fault.

He sounds polite enough in his email, but technically everything he said is true. I agree that at $3.95, the package should have insurance and a free stick of gum in it, but honestly its only a few bucks and like has been mentioned, the postal service vacuum could have it in storage for delivery in 2008. I'd give him the benefit of the doubt unless he has a lot of feedback that says "item not received".

I would wait a week and ask for a refund, if he declines, chalk it up to a $10 lesson on people who dont offer Paypal.
IT IS ALWAYS CHEAPER TO NOT SELL ON EBAY

The seller should refund the buyer if it never gets there, regardless of the reason. if he doesn't refund your money, tell the c*ksucker to f-off and neg him.
