Question about paypal dispute

So, what can I expect? The only other dispute I dealt with had a seller who decided not to respond, and lost by default.

The story so far...

I won a 1993 SP Jeter rookie in a PSA 8 case. I emailed the seller to ask if there were any scuff marks on the card (the picture provided wasn't too good). The seller assured me that what I saw in the scan was glare from the camera, and that there was no scuffing on the card at all.

The card arrived, and what looked like either scuffing or glare in the pic was... scuffing on the card.

The seller insists that he did not misrepresent the item and refuses a refund.

We went around in circles with that a few times, and I've decided to escalate the issue to Paypal's claims system.

The seller's added info such as having sold the card for someone else, and not having any money to give a refund if he wanted to.


So, what other steps can I expect?

  • IMO, you might be stuck on this one, but for your sake I certainly hope not. Good luck. Keep us up to date.
  • File is SNAD and Payapl will tell you what to do from there. Best case is they have you ship it back with DC and once it arrives they refund you. However if the seller does not have any money in there you may end up stuck.

    So, worst case scenario, I send the card back, and the seller say's "thanks, I don't have any money" and I'm out both the card AND the money?

  • I would forget about the paypal since you may or may not get your money back. Just list it back on ebay and you should be able to re-coop most of your money.

    If the scuff is as bad as you say, I wonder how it ever made it in a PSA 8 holder? Got a scan?

  • Yeah, I can see it. Like I said, I would just list it back on ebay. If anybody asks you if it is on the card or on the case, just be honest with them.

    I try to "buy the card, not the holder." I don't mind some corner touches, I DO mind a nasty scuff that interferes with eye appeal.

    The whole mess here is.. I asked the seller specifically if there were scuff marks on the card, which wasn't totally clear from the digital camera picture. The seller said no, that there were no scuffs, and anything that looked like a scuff was glare from the flash on his digital camera.

    Card arrives, and has scuff marks.

    Some how, though the seller lied, he thinks he didn't do anything wrong.

    I would file the claim anyway. Unless he has a low feedback, he may get upset, but will refund the money. If he doesnt, Paypal would suspend his account. Then if he ever wants to sell again, you dictate the terms

    100+ feedback, he even left pos feedback for me already.

    Based on the name in the Paypal account, his previous Ebay ID is a 1200+ pos feedback account with just 1 neg (from a while back), but is NARU'ed as of May 07.

    Well, Paypal decided that it wouldn't grant a refund.

    I guess as far as ebay/paypal is concerned, as long as the card is graded, you can say what ever you want about the card to boost the final price.

    Leave a neg, sell the card with a clear scan. Should at least get close to what you paid for it. Most people buy the holder and cards like this that are commonly sold daily usually bring close to market avg.

  • Very, very simple. Report the transaction to your credit card company. If you're in the right, you will get your money back.
