I would like your opinion on this situation...

I bought a set of 2004 UD and it was "guaranteed"....i got the set and some base cards were less then 4 if graded.....some had large dings and a few of the rookies did as well...none of the SP's did. The guy said sure its guarnateed I will let you know when the cards you want replace are received.

now..then...as a customer who has already paid should i be FORCED to spend my own money to send cards back to him??? Especially when the cards are NOT SP's and are merely COMMONS??

He already as my 275 bucks and i got a set that im not happy with. What do you think?? Is it reasonable to for him to just send the cards at my request??

I would expect cards like that from a "set" if the price was pretty good.....

Cards were guarnateed MINT....cards are less then 2 years old. If you pay for something you should get it...especially from a large dealer.

if you want the cards replaced i would send them back and pay return postage but have him send the new cards back with free shipping. if you buy something at a store and have to return it you'd pay for the gas to get there. if it's a readible avaialble set and you are unhappy i'd send the whole thing back and get a refund.

You might not like what he sends you back.

If the seller has good feedback he probably just wants to make sure the cards are actually damaged and also wants to make sure he's getting them back. It's possible he bought the set that way and never looked at them.

Like was said above go ahead and send them back. Scan them first and make sure he signs for them. Do it fast so you keep your rights under ebay/paypal.

    Lothar52 ,

Some of the better large dealers would just send you the damaged cards you requested, especially since these are not the high value ones (like the SPs).

The fear is he might send you cards back that are damaged in some way (unintentional). You may never rightfully get what you were promised, so returning the whole thing might be the better option.

We discussed how some large dealers just send replacements without wanting the damaged item first especially when the customer has such a good feedback rating. Was this bbcExchange? There were a few dealer that do this. I wish I can list them for you so you can buy from them. One dealer sold a boardmember a hobby box of vintage cards. All the cards were water damaged. The dealer apologized and gave full refund without requiring a return.

Not sure what the problem is. At best it will cost you a dollar or 2 to send back the damaged cards?

no the dealer is SMCCI. Sometimes I get on a modern football kick...dont know why..but the regular UD set really REALLY looks nice and this one was up for actually 279 plus 7 dollars shipping and i sprung for it. With the cards guanateed Mint and him having 100% feedback i thought for sure if i had any problems they would just send the replacements without me having to work for it..after all..it is 280 bucks up front for a modern set...come on....

The problems runs with my schedule...this month i work every day but 3...i worked this morning for 5 hours...not enough time to get to the post office and in general i never have enough time during the day. I dont have that extra special someone close enough to take care of this for me if you know what i mean...I dont know..i just seems like a hastle i shouldnt have to deal with considering he already has my money in his bank account...THE CARDS WERE GUARANTEED...FINAL...if i say something is wrong he needs to make it better...not me...I just wanted to see if I understood what his responsibilities were and from im seeing here its a mixed bag.

You could ask him to send you a couple of bucks when he sends the replacement cards to cover your shipping costs. I missed a dent in the front of a card I recently sold, offered a replacement card or refund and included a couple of $1s when I sent the card to cover the shipping and the hassle. Some dealers would be happy to do this to ensure the customer ends up happy.

I once again explain it to him my wishes and he REFUSES TO COMPLY.....I DONT UNDERSTAND THIS....I TOLD HIM AFTER I COMPARE ID SEND THEM BACK....I DONT SEE WHY MY REQUEST IS UNREASONABLE WITH HIM HAVING MY 279!!!!

mike, i have purchased 4 base sets at my own expense from which to switch out the 75 of 200 base cards that need replaced either to large corner dings or bad edges...below are the 8 non-sp's i wish to be replaced. i would like to compare in person to the other 8 non-sp's myself, and would like to request you send these 8 cards. If you so wish I would send the 8 cards i choose not to keep back to you in the mail. the following non-SP rookie cards are as follows:

    240 hall
    241 vasher
    247 jones
    257 harris
    261 morant
    263 wilson
    269 symons
    275 colbert

Please let me know if this sounds reasonable.

    Ryan

    HIS REPLY:

    Hello Ryan,
Sorry to hear you went through all that trouble to upgrade the set, wish you had sent them
back to us as we could have saved you the extra cost. Please mail those 8 cards to me and
I'll compare the 3 or 4 different we have of each and send the best. I can't mail all of them
to you as I'd have too many incomplete sets in inventory but assure you I will pick the best
and send ASAP. Please advise when they ship and we'll email when they arrive. Thanks! Mike--SMCCI

Please do not take this wrong but the guy is not being unreasonable. He wants you to send the cards back and he will send you the best he has. You need not go to the post office to mail them back either. Simply place the cards in a bubble mailer and add three 37 cent stamps and put them into the outgoing mail or mail box.

You seem to think that just because he has your 279.00 that you are entitled to special treatment. (please do not take that the wrong way) I am simply showing his side. You may not be the only person that he does this for and he has a simple procedeure in place and that is when a customer is not happy he expects them to send the card(s) back and he then fullfills his obligations.

Just some friendly advice...........send him back the cards you are not pleased with and let him fullfill his obligation.

    Good for you.

YEAP...that about sums it up steve...you hit it right on the freakin head. I was required to PAY 279 dollars for a set thats guaranteed BEFORE... I have it... and he doesnt seem to TRUST ....that ill send him his extra 8 cards back. He could simply pick out the best 8 he has and send them...I can then choose the best of his vs what i got and be SATISFIED with MY PICKS. Now I have to trust a guy to pick the best for MY SET based on his standards which sucked in the first place. AM i entitled?? HELL YES...IM THE CUSTOMER...anybody who pays for a service should get the service they request when indeed its reasonable...I think him trusting me and allowing me to choose the best card for MY set is 100% reasonable. Now he can send back 8 crappier cards then I already have and when i request another exchange im being 100% unreasonable or a troublemaker at THAT POINT. It puts the ball in HIS CORNER. I DONT SEE HOW MY REQUEST ISNT 100% REASONABLE CONSIDERING HE HAS HIS PAYMENT. I SURE HOPE ANYONE WHO THINKS SO BUYS FROM ME AND PUTS THE BALL IN MY CORNER IF NOT SATISFIED....UNREAL

I did not say that your request was not reasonable. however, he is the seller, you the buyer. If you want him to honor his guarentee then you have to abide by his rules. I do not see him being unreasonable either. You obviousely are happy with all but 8 cards. If not return all of them for a refund then. Not sure what else I can say here.

I was just trying to do what you asked ............you did ask for opinions.
    Good for you.

Here is the way I see it.

Why doesnt he trust someone when they paid up front for the cards and are not satisfied. I have sent replacement cards and never requested the other cards be sent back. I can understand if he wants them back but why should lothar send cards back to him and risk getting worse cards back or nothing back???

  • I have spent many years with the same issue, which is why graded cards are so much easier to deal with. I am upgrading my 1970 Raw BB set while building my average PSA set at 8.65 and trust me, people sill think that so long as the card has four sharp corners, it is Mint. I also agree, the seller seams reasonable, so work with him to up grade "for 37 cents" from his inventory the commons that need some help. Good luck !!!

Sounds like he has 3-4 other sets and is just going to switch them out to upgrade you and sell those junk commons to someone else with those sets. Otherwise he would break a full set to get the 8 cards to you. Just send them back to him and get your replacements.
  • Lothar52Lothar52 Posts: 2,664 ✭✭✭
i will have too...im going to look them over and determine if im being a bunger on this one..maybe look online for some that i see good pictures of....i just dont trust a dealers version of MINT....Loth
  • Lothar,

What numbers do you need replaced???
I opened a few boxesof that stuff and it's laying around in the backroom somewhere....you can have what you need (IF I've got them)...

    Lothar,

I would not trust the dealers version of MINT either. It sounds like there were 75 cards that were messed up and you replaced most of them at your own expense. The dealer should be happy that he has to only send you 8 cards--to demand the ones you have back is not out of line but its in poor taste considering what you went through already. However, it sounds like he really needs the cards because he has to put that junk in the other sets he has for sale. I can't believe he admitted to that--I would not buy from him if that's the kind of thing he does to his products. He should have had boxes and boxes of commons available.

Andre I did not get that impression. The impression that I got was that Lothar over time has used 4 sets to make 1. That this set he felt 8 were bad.

In any event I agree that the seller wants those careds back so he can put them back in the sets that he will take (what he feels) is his best and send those to lothar.
