I don't think I'm gonna get paid for this auction...

I put a fairly low BIN (at the time) on the Tomlinson because of a small condition issue and since I wanted to sell it fast; the would-be-buyer locked in the BIN fairly fast. A couple of days later I get this spiel about how somebody screwed the sller out of $7000 and asked for my patience; I'm definitely not the one to get suspicious about claims like this right off the bat, so I agreed and gave the seller until 15 days after auction close before I sent a very polite reminder for the seller to pay or tell me that payment is not possible so I can relist. This is four days after that reminder, so I sent the seller this:

Please pay by PayPal or send payment via a trackable shipping method and remit proof of mailing by Thursday. If not able to pay for this item, please let me know so I can relist the item. Otherwise, I will be forced to begin a non-payment claim. I believe I have been reasonable in my allowances to you given your cirumstances, but I will respond swiftly and severely if I believe I am being taken advantage of. I genuinely hope that this is not the case and that this transaction can end successfully in some way. Thanks for your time and consideration.

Thing is, most of the seller's feedback is from buyers; I think the seller bought thinking he/she could flip the card and got cold feet after later copies dropped in price. Regardless, I believe I'm not going to see the $$$ from this bastidge for this card. What do y'all think?

  • I think the guy is messin' with you. Scammers have a story - buyers have money. He has bought (and paid for) quite a few other items since the end of your auction. I would immediately file an Unpaid Item Dispute and stop any communication with him. No reason to give him an opportunity for more stories. At the end of 8 days, you'll either have your money or you can then close the dispute and get your FVF back from Ebay and then relist. Good Luck.

    I think you're probably S.O.L.

    One thing I'd consider doing in the future is being straight forward about the condition of the card in your auction description. You say that you've put up a scan so the bidders can judge the condition for themselves, but in 'Ebayese' almost always translates to 'Card has a small surface wrinkle, but since you can't pick up on that from the scan I'm going to burn you pretty good'. It wouldn't surprise me if the buyer looked over your auction description once more after he bid, began to wonder why you had a BIN with below market value on a hot card, and this combined wth the ambiguous language in the auction description just turned him off.
    Not that any of this puts him 'in the right', but by changing the way to describe cards you may be able to avoid something like this in the future.

    I would file an Unpaid Item as well. Don't let the guy off the hook just so you can relist. You would be suprised how quickly most people pay once you file the dispute. Let us know what happens.

    The feedback he's received for some recent payments to sellers has come in the last few days and was for auctions ending on 12/4, the same as yours. I'd give the buyer a couple more days to pay, however I would file the non-paying bidder claim just to give things a jumpstart. It is xmas time and mailed payments can be slow (assuming it has been sent). The possibility does exist the buyer has no intention of paying now, but while scammers usually do have a story, at least they are taking the time to give you a story. If you don't have your payment by the end of the NPB dispute, relist, leave a neg and move on. Hopefully the Chargers will be in the playoffs and you'll still get a good price for the card.
