1976 Nolan Ryan "PSA 9"......

So I see this Nolan Ryan PSA 9 on Overstock and it goes for well under SMR so I bid on it. I get the card in the mail and the case has been cracked open, a EX/Mt to NrMt Ryan was inserted, and a bad copy of a legit PSA flip is inserted. Are you freaking kidding me? Has anybody seen anything like this? I looked at some of his other auctions and he had counterfeit Jordan and Rose RCs, but also a bunch of legit PSA graded cards (4s, 5s, 6s). I emailed him threatening to go to Overstock, Ebay, paypal, and his local authorities (I have his name and address) unless he refunds my money within 2 days, and he doesn't want this kind of trouble over $150 yadyadyada..... Any suggestions?

Lee

So you won that auction, eh?
I was watching it and was surprised at how much that card went for.

I don't think 60% of SMR is all that high (if it were real).

Had the auction been real - and the bidding was hot & heavy like people assumed it was - you're absolutely right.
I guess I was surprised at the intensity of the bidding on a new site.

The fake Rose went for a nice piece of change too.

I'd report it to Overstock and see how they handle it.

Hmmm...I think I remember someone telling me how "absurd" it was that anyone would switch a card in a PSA case. image
Oh well...guess there are people out there willing to give it a try.

OK, so I get a response from this jackass:

    "Lee,
First things first, I am not a collector or grader of cards. I couldn't tell you the first thing about them. I bought a box of mixed cards for the heck of it and put some up for auction. I'm sorry that you think it's fake or whatever. I have no problem refunding your money but I want my card back first. I have been scammed for a lot of money by people who don't send the item or send me junk so I don't trust anyone anymore. Please don't threaten because that would fall under liable and slander. Sorry you don't like it. Send it back and I'll refund the money to you. That's what the police will tell you. I know because I am one. Thanks!"

    I respond with:

"First off, if you were a police officer, you would know that the word is "libel", not "liable". And secondly, threatening to take legal action against somebody is not libel or slander. I will return the card tomorrow, but before doing so I will take several up close pictures of the card, case, and PSA flip so I have proof that this card is not legitmate. Just so you know, I have your name and address, the auction from Overstock plus two other auctions of yours in which you're selling bogus cards, the paypal transaction, and pictures of the altered PSA case you sent me. If you don't think this is enough to get the police to at least take a good look at you for all this stuff, you're deluding yourself. If you think all this trouble is worth $154.50, you're foolish. If I do not have payment within two days of the date of delivery confirmation, there is a 100% chance I will take legal action against you; I've done it before to people who have scammed me, and very successfully I might add.

    Lee"

I'm about 95% sure he's not returning the money, but I guess we'll soon find out.

Seems like he has an out with the excuse of "case broken, you took the one that was in there, and now trying to screw me over".
Even with your emails, pictures and contact with him. Hopefully you're able to recoup your $$.

Funny-I know, because I am one. If he's a cop, I'm the king of England.

Lee, I really hope you get your money back. I truley hate theives. I have a grounds maintenance/landscaping business and my yard is perfect. I live right on a busy street so I went out and had two yard signs made with my company logo and phone number on them. I figure my yard speaks for my work and the signs would be great advertising. Anyway I pull up today and both of my signs are gone. image I have zero tolerance for jerks that have to steal from others because they are too lazy to do anything for themselves. They would rather steal from people that actually work becuase its the easy way out! Anyway I hope you get your money back and pursue legal action against this ass so he thinks twice about doing this again.

I like your response, Lee. Maybe when it's all over, you should report him to the police for impersonating a police officer.
