Interesting lawsuit. To answer KoinDawg's question, the plaintiff does have to prove the allegedly defamatory statements were false, and may under these circumstances have to prove in addition that the person making them knew they were false. I am noticing an "over emphasis" narrative forming regarding defensive WAR vs. offensive WAR. I don't know that defense isn't being over emphasized, but I can't find the over emphasis.
