I am in favor of seizing the assets initially, to assure they are not dispersed prior to trial. However, if the individual(s) are not charged or charged but acquitted, the assets must be returned. Seizure without due process is criminal (i.e. search warrant/just cause), as is retention of property without conviction. Cheers, RickO

They forget, (conveniently), that you aren't a Drug Dealer until someone PROVES you are a Drug Dealer.....
The biggest and deadliest "Drug Dealers" are big para pushing opioids ....
This is because of a series of abusive court decisions dating back even to the 1800s that created the legal fiction that the property is "guilty" and thus the government can proceed in rem. In rem administrative forfeiture has been used to skirt due process concerns for some time. It is time for SCOTUS to step in or for Congress to fix (although I wouldn't hold my breath on the latter.).

A prosecutor from Hunterdon County, NJ sucked his 9mm over fraudulent seizure. He set up a property owner, took the land and the plans for a house. Built the house a per specs and moved in. Nice.
Unreasonable search and siezure procedures are getting way out of hand.
One aspect of this can certainly impact those of us in the coin hobby/industry. If you are traveling to a show with lots of cash and have the misfortune to have an unexpected meeting with law enforcement in certain places, you can lose that cash fast. It is getting common to regard cash in the amount of more than a few hundred as 'suspect' and likely for 'drug purchases'. It is up to you to prove that you are NOT using the cash for any illegal activity. Good luck in getting the money back once the government gets ahold of it.
I like buying property that was seized and then sold. Usually really good stuff.
Once bought a collection of antique spurs from a sale, that the owner was eventually convicted of money laundering and small arms sales to a nation that that was not allowed. Spent a little under ten grand and sold for a little more than 50 grand. Sweet deal.
