OT: Paypal return question

I don't think I've ever had to return anything in almost 12yrs on eBay (card people are better!) so I'm pretty rusty with the best eBay / PayPal return methods, so if you have a chance any advice would be appreciated. I bought a 'new' set of DVDs (used PayPal). Fast shipping, well packaged. However, the actual DVD box had some noticeable wear, but more importantly I could see remnants of a price sticker under the shrink wrap. I still didn't really care (b/c these are for my brother so cosmetic stuff doesnt matter), but I took the wrap off to check the actual DVDs. Sure enough DVD1 is scratched up.
So, is is better to go via eBay claim via their site or PayPal claim via their site (I'm not even sure if they're that different anymore). Also, should I even bother to contact the seller or just open a claim? I don't think it was deliberate in the sense of fraud, but I think more of volume/don't care attitude. What concerns me is the seller's return policy says: "This item must be returned within 30 days after the buyer receives it. The seller pays for return shipping. The refund will be given as Money Back. More details from the seller: Returned items must be in original conditioned as purchased." ... Makes me think he will make an issue out of me opening it / has been down this road before. However, how would I know they were used/damaged before opening them? In a normal world I'd just work with the seller directly but eBay/PayPal is anything but a normal world these last years.
Any chance I get reimbursed for return shipping (w/ DC of course)? I'm not trying to be difficult here but I'm pretty annoyed that I'm going to have to go thru all this return BS for about $20, and more importantly I don't want to get hosed by a seller that clearly has much more eBay savvy than me. If you want to straight to opening a dispute go directly to paypal and use the reason significantly not as described. Should not be an issue but you will be on the hook for shipping unless you can get seller to agree by contacting him first.

Not surprising, I guess he thinks that re-wrapping used items and selling as new protects him b/c people can't find out the condition w/o opening it and therefore 'violating' his return policy. I guess it's on to a PayPal claim. Does it matter if I mail the item back first or should I just open the claim first? Also, does the timing of my giving him negs matter? I shouldn't have any more questions after this - thanks for your help.
Once the claim is filed send it back with D/C. MAKE SURE YOU INCLUDE THE D/C/ NUMBER ON THE EBAY CLAIM.
When the package arrives you should have the refund in a day or two.
