The pending motions were fulling briefed by 12-16-2009 when the last set of reply papers were filed.
Three months have gone by and nary a peep from the court on how it will rule or when it will rule. For the big ruling last July that ordered the government to file a forfeiture proceeding the court took two months after the final reply brief to issue its ruling.
Wonder what is taking so darn long for the court to rule on the two pending motions?
Anyone have a clue?

I missed winning by just a couple hours.
I hope they get one to have a giveaway.
It will impact how hard the thumb can come down from our benevolent Gov't. onto a private party. I suspect there is a lot of pressure being brought about by Uncle. I also suspect that this ruling might go against Uncle. Certain Justices did not appreciate a recent State of the Union speech....

It takes me back 25+ years ago when I was a baby lawyer cutting my teeth. I worked in So. Cal. law firm that had a court appearance intensive practice. I would go to a particular So. Cal. courthouse for afternoon calendar that was set to start at 1:30 p.m. The courthouse had 8 courtrooms identified as Courtrooms 1, 2, 3, 4, 5, 6, 7 & 8. Time after time I showed up at 1:30 p.m. only to sit around until 2:00 p.m., 2:30 p.m. and a copule of times until 3:00 p.m. for the judge to take the bench. Many times the courtroom was packed with lawyers and their clients, just sitting around.
I finally asked another, older, attorney if he was a local attorney who regularly appeared in the particular court. He said yes. I asked him why the judge was routinely late taking the bench for the afternoon calendar. He asked me if I had ever heard of Department 9. I said no and that I understood there were only 8 courtrooms in the courthouse. I asked what is Department 9? He told me that Department 9 is a local restaurant [with a name other than Department 9, which was only a nickname] where all eight judges would have lunch each day; and that during lunch the judges would imbibe their favorite adult beverage and get drunk.
After hearing this I never worried if I wa running late to this court. Sometimes I did not show up until 2:00 p.m. and never had a problem.
I think that was really "District 9." They had prawns for luncheon....

We may be exaggerating the influence of our corner of the world. Unless this thing gains a lot of media traction (it hasn't yet) I doubt anyone outside the numismatic community will really care.
As for SCOTUS & POTUS, that problem is easily solved by them just not showing up at the State of the Union speeches. Like they are supposed to sit there the whole time and not react to anything the Prez says. That's just lame. What are they, just props for His Highness? The speech is so politically crafted anyway they may as well go with the Tiger Woods format. Btw, I am an equal opportunity skeptic - this applies to both parties.
